8-6-1: DATUM PLANE ESTABLISHED:
There is hereby established a base or datum plane of reference to which all city levels, and all permanent grade points, hereinafter established, shall refer. Said base or datum plane shall be taken as a reference plane, and is hereby established at one hundred feet (100') below the top of a bronze pin set in a concrete post in the southwest quarter of Jones park in the public square in the city, and being approximately at a point forty four feet (44') east of the outer face of the curb on the west side of said Jones park, and two hundred four and seven- tenths feet (204.7') north of the outer face of the curb on the south end of Jones park. The permanent grades of all streets and alleys in the city, hereinafter fixed, shall refer to said base or datum plane. The U.S. geological survey elevation is equal to five hundred sixty two and six-tenths feet (562.6') plus the city data. (Ord. 875, 3-17-1981)
8-6-2: SIDEWALKS TO CONFORM:
No person shall construct or lay, or cause to be constructed or laid, any sidewalk where no grade has been established without having first obtained a grade therefor from the city engineer, or contrary to any grade given by said engineer, nor shall construct, or cause to be constructed, any sidewalk contrary to any grade which may have been, or may be hereafter, established by the council, under a penalty of twenty five dollars ($25.00) for each offense, and a further penalty of five dollars ($5.00) for each day that he shall fail to make said sidewalk conform to the proper grade, after five (5) days' notice so to do by the superintendent of streets. 8-6-3: NEW SIDEWALKS TO CONFORM:
All new sidewalks that may be rebuilt, shall be built on and made to conform to the grade which shall be established by the city engineer, and a record of the sidewalk grade when established, shall be kept in a book provided for that purpose, and permanent stone landmarks set below the frost line to keep the grade line as established in a condition to be ascertained for the purpose of public improvements in the city. Any person violating any of the provisions of this section shall be subject to a penalty of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each and every offense.
