Wherever in this chapter the following words or terms are used, they shall have ascribed to them the following meanings:
BUSH OR SHRUB: A woody perennial plant smaller than a tree with close branches arising from or near the ground.
TERRACE: The land lying between a street or roadway and sidewalk.
TREE: A perennial plant having a self-supporting main stem or trunk which develops woody branches some distance from the ground, and grows to a considerable height and size. (Ord. 143, 7-20-1965)
No person shall plant or remove any tree, bush or shrub on any terrace or land within ten feet (10') of any sidewalk, street or roadway within the corporate limits of Canton, without first having obtained a permit.
Any person desiring to plant or remove on any of the places above set forth shall apply to the office of the clerk. The clerk shall furnish such person with an application requesting the following information:
(A) Name and address of applicant.
(B) Species of tree, plant or shrub to be planted or removed.
(C) Sketch showing location of tree, bush or shrub to be removed or planted, with measurements of adjacent sidewalks, streets and roadways, and street intersections.
(D) Such other information as the committee on streets and alleys deem reasonable.
The clerk shall furnish the applicant with a list of the species of trees that may be planted.
The applicant shall return his application to the clerk who shall refer the same to the superintendent of streets, who, if he finds the application complies with this chapter shall then approve the same. The clerk shall then issue a permit to the applicant who then may plant or remove said tree, plant or shrub in compliance with the permit. The superintendent shall inspect the premises where said tree, plant or shrub has been planted or removed to see if the applicant has complied with the terms of the permit.
In granting said permit and in his inspection, the superintendent of streets shall see that the provisions of this chapter are reasonably complied with and may refer any application or inspection to the committee on streets and alleys for its opinion. (Ord. 143, 7-20-1965)
