1198.10 SPECIAL CRITERIA FOR RESIDENTIAL SOCIAL SERVICE FACILITIES.
   (a)   Submission Requirements. The applicant for a conditional use permit to operate a residential social service facility shall submit the following information in written form, prior to a public hearing, to aid the Board of Zoning Appeals in their review of the requested facility.
      (1)   Site plans, showing the location and layout of the structure, off-street parking, recreation and open space facilities.
      (2)   Written narrative exhibiting evidence that the proposed use of the site will be compatible with the present physical character of the neighborhood and will not disrupt the neighborhood from the standpoint of noise, congestion or traffic generation.
      (3)   A license, or statement of need for a license other than City licensing and evidence of obtainability, from the appropriate governmental unit or agency. When a license is not required of the applicant by a governmental unit or agency, a written affidavit shall be presented by the agency to which the applicant is accountable stating that a license is not required. The affidavit shall further state and describe the procedures that have been established in lieu of licensing to insure proper exercise of agency established guidelines.
      (4)   The sponsoring agency's operational and occupancy standards.
      (5)   Documentation which indicates the responsibilities of both the sponsoring agency and the facility operator in terms of services, programs and care.
   (b)   Facility Requirements.
      (1)   Every facility shall provide not less than 120 square feet of outdoor recreation open space per person, exclusive of required front and side yards and parking areas, consolidated in a useful configuration on the home premises.
      (2)   No exterior alterations of the structure shall be made which depart from the residential character of the building. All new structures shall be compatible in residential design with the surrounding neighborhood.
      (3)   No residential social service facility shall be located within 1200 feet of another such facility.
      (4)   Off-street parking shall be required pursuant to Chapter 1161 of this Zoning Code.
   (c)   Findings of the Board of Zoning Appeals. The Board of Zoning Appeals may grant a conditional use, or a temporary conditional use which shall be reviewed at the end of one year and revoked or made permanent thereafter in accordance with procedures set forth in this chapter.
The certificate of occupancy will not be issued without evidence of a valid license having been issued by the City License Inspector, in cases where the license has not yet been issued by the time of the Board of Zoning Appeals hearing of the conditional use application.
