1196.09 NOTICE OF HEARING BY MAIL.
   If the ordinance containing the recommendation of the Planning Commission for a zoning change intends to rezone or redistrict ten or less parcels of land, as listed on the tax duplicate, written notice of the hearing shall be mailed by the Clerk of Council by first-class mail at least twenty days before the day of the public hearing to all owners of lots lying within 300 feet of any part of the parcel which is proposed to be rezoned or redistricted, to the addresses of such owners appearing on the County Auditor's current tax list or the Treasurer's mailing list, and to such other list or lists that may be specified by Council. The failure of delivery of such notice shall not invalidate such ordinance. If the ordinance intends to rezone or redistrict more than ten parcels of land, the foregoing requirement of written notice shall not be required, except where the zoning amendment is initiated by a property owner or his agent, in which case written notice shall be required.
