(a) The Commission (and Council) shall approve, modify and approve, or disapprove the GDP based on review and comments from the Site Plan Review Committee. No permits shall be issued, nor shall any construction activity of any kind commence, for any work depicted on an approved GDP until such time as a Site Plan has been approved by the Site Plan Review Committee.
(b) The Commission (and Council) may approve, approve with minor changes or modifications, or disapprove any application for the GDP within the TIZ. In considering any GDP approval within the TIZ, the Commission (and Council) shall make a finding that the GDP, Site Plan, and Parking Demand and Management Study are consistent with the TIZ Regulations, the most current comprehensive plan, and subsequent amendments approved by Council, and are adequate to ensure safe and appropriate implementation of permitted uses.
(c) In reviewing any GDP application submitted, the Commission (and Council) shall determine the following:
(1) That the application is reasonably consistent with the Core Targeted Investment Areas recommendation in the most current comprehensive Plan, and subsequent amendments approved by Council. In these regulations "reasonable consistency" means that some variation or deviation from specific provisions is acceptable, provided that the overall intent of the provision is achieved with respect to health, safety, environmental and other land use considerations.
(2) That all other applicable provisions of the Canton Zoning Regulations have been addressed. Specific building locations that are depicted on zoning permit applications may differ from building locations depicted on the approved Master Plan, so long as all other requirements are satisfied.
