Chapter 713 and the sections thereunder of the Ohio Revised Code empower the City of Canton, Ohio to enact a Zoning Ordinance and to provide for its administration, enforcement and amendment; and
Whereas, Council deems it necessary for the purpose of promoting the health, safety and general welfare of the City to enact such a Zoning Ordinance; and
Whereas, Council, pursuant to the provisions of Chapter 713 and the sections thereunder of the Ohio Revised Code, has appointed a City Planning Commission to recommend the boundaries of the various districts and appropriate regulations to be enforced therein; and
Whereas, the Planning Commission has framed a plan for dividing the City into districts and has prepared regulations pertaining to such districts in accordance with a comprehensive plan for the purpose of regulating and restricting the location of buildings and other structures and of premises to be used for trade, industry, residence or other specified uses, limiting the height of buildings and other structures, regulating the bulk and location of buildings and other structures, the percentage of lot occupancy, setback building lines and the area of yards, courts and other open spaces, providing for the method of administration, and for an administrative board and for imposition of penalties for violation; and
Whereas, the Planning Commission has given reasonable consideration among other things, to the character of the districts and their peculiar suitability for particular uses, with view to conserving the value of buildings and encouraging the most appropriate use of land throughout the City; and
Whereas, the Planning Commission has made a report and submitted its report to Council; and
Whereas, Council has given due public notice of hearings relating to zoning districts, regulations and restrictions and has held such public hearings; and
Whereas, all requirements of Chapter 713 and the sections thereunder of the Ohio Revised Code, with regard to the preparation of the report of the Planning Commission and the subsequent action of Council have been met;
