777.05 POSTING OF NOTICE; APPLICABILITY; ALTERNATIVE COMPLAINT PROCEDURE.
   (a)    Every employer manufacturing, using or storing hazardous or toxic chemicals in the work place shall post a sign in the form attached as Exhibit "A" at the location or locations where notices to employees are normally posted to inform employees that they or their designated representative has a right to information from the employer regarding the hazardous or toxic effects of the chemicals and the circumstances under which these effects may be produced.

   (b)   Each employer, to include employers in SIC Codes 20 - 39 who are subject to coverage by the requirements of Section 1910.1200, Title 29, Code of Federal Regulations (Occupational Safety and Health Administration's Hazard Communication), shall develop and implement a hazard communication program for his or her work place which meets the requirements of this chapter. The employer may rely on an existing program to comply with these sections provided it meets the criteria specified in this chapter.
   (c)   Employers in SIC Codes 20 - 39 who are subject to coverage by OSHA's Hazard Communication shall be subject to all regular inspections by the City Fire Department pursuant to Section 777.10(c) and all other requirements of this chapter with the exception of the complaint procedures set forth in Sections 777.10(d) and 777.16(c) which shall be modified as follows for these employers only. In order to avoid duplicative investigations by OSHA and the Fire Department on the same complaint, employees employed by employers within SIC Codes 20 - 39 who are subject to OSHA's Hazard Communication shall be required to first submit complaints which are subject to the jurisdiction of OSHA to OSHA; if OSHA fails to investigate and make findings within three working days of the filing of the complaint, the employee may then file the complaint with the Fire Department which will then investigate such complaint in accordance with the procedures set forth in Sections 777.10(d) and 777.16(c).
