When the Mayor is absent from the City, or is unable, for any cause, to perform his duties, the President of Council shall be acting Mayor with all the powers and duties of the Mayor. In case of death, resignation, or removal from office of the Mayor, the President of Council shall become the Mayor and serve for the unexpired term and until his successor has been elected and has taken office.
The Mayor shall be the chief executive and administrative officer of the City. He shall be responsible to the Council for the administration of all City affairs placed in his charge by or under this Charter.
(1) Except as otherwise provided by or under this Charter, he shall direct and supervise the administration of all departments, offices and agencies of the City.
(2) He shall be an exofficio nonvoting member of all boards and commissions, including the Board of Public Affairs.
(3) He shall see that all laws, provisions of this Charter and acts of the Council, subject to enforcement by him or by officers subject to his direction and supervision, are faithfully executed.
(4) He shall prepare and submit the annual budget and capital program to the Council.
(5) He shall submit to the Council and make available to the public, a complete report on the finances and administrative activities of the City as of the end of the fiscal year.
(6) He shall keep the Council fully advised as to the financial condition and future needs of the City and make such recommendations to the Council concerning the affairs of the City as he deems advisable.
(7) He shall make such reports as the Council may require concerning the operations of City departments, offices, and agencies subject to his direction and supervision.
(8) He shall perform such other powers and duties as are specified in the Charter, by ordinance or resolution, by law, or as may be required by the Council.
Within 96 hours after the adjournment of any Council meeting, the City Clerk shall present to the Mayor the record of proceedings of the meeting and all ordinances and resolutions adopted at the meeting. The Mayor, within seven days of receipt of an ordinance or resolution, shall return it to the City Clerk with or without his approval, or with his veto. If an ordinance or resolution is vetoed, the Mayor shall attach a written statement explaining the reasons for his veto. Ordinances and resolutions vetoed by the Mayor shall be considered at the next regular meeting of the Council, and the Council may pass the ordinance or resolution over the veto by the affirmative vote of not less than four-fifths of its members. The Mayor's veto power shall extend to disapproving or reducing individual appropriation items in the budget or any ordinance or resolution, except appropriations for auditing or investigating any part of the executive branch. When the Mayor returns an ordinance or resolution to the City Clerk without his approval and without his veto within the seven day period, the ordinance or resolution shall become effective as though he had approved its passage.
