RATES AND CHARGES
The Village Council shall assess and collect proper charges for water and material supplied, and work done, and any owner of real estate premises installing or maintaining water service connections shall be considered as accepting the provisions of all lawful rules and regulations of the Village Council, and agreeing, in particular, to be liable for all such water and service charges for such premises, whether the accounts for such premises are carried in the name of such owner, or in the name of tenants, or other persons.

(A) Water rates for the village shall be decreased and to take effect January 2020, billing as follows:
First 2,000 gallons | $3.38 per 1,000 gallons or part thereof |
Above 2,000 gallons up to 30,000 gallons | $2.52 per 1,000 gallons or part thereof |
Above 30,000 gallons | $1.78 per 1,000 gallons or part thereof |
Plus capital charge | $21.06 per account |
Monthly minimum including capital charge | $24.44 per account |
(B) An automatic increase.
(1) Village Council hereby authorizes automatic increases of all water charges once per year, every year, beginning on January 1, 2021 and every year thereafter by a fixed percentage. This automatic increase shall apply to the water usage fee, the capital charge, the tap fee, and the bulk purchase fee, and any other service charges.
(2) The fixed percentage shall be 2.75% unless Council approves an action to adjust this amount prior to the automatic increase date. Every three years a water rate study will be performed in a timely manner to provide Village Council with relevant information to allow them to conduct an informed review of the water rates and the financial stability of the village water operations.
(3) The automatic increase shall be effective on January 1 of each year and be reflected on the customers’ February bills and be effective throughout that 12-month period.
(D) Service deposits for water service will be $30.
(E) Water service tap fee. The village shall require a deposit of $1,500 for tapping a village water main. The village will perform the tapping of the main, and furnish and install the piping, corporation stop, curb stop and curb box, and other appropriate materials. The cost to the village will be applied against the $1,500 deposit, and any funds remaining shall be refunded. Should the cost for the tap exceed the $1,500 deposit, the applicant shall pay the difference before the water service is turned on.

(A) The village shall permit sales of bulk water to residents and nonresidents.
(B) The costs of such service shall be established yearly by the Village Council. A premium charge shall be added to the purchase of bulk water by a nonresident of the village.
(C) No individual or organization, with the exception of the Village Fire Department, shall attempt to take water from an unmetered receptacle without the bulk direction from the Water Department Superintendent.
(D) The Water Department Superintendent shall establish procedures for the receipt of bulk water.
(E) Use of private owned swimming pools can be filled through a bulk purchase or by a home connection. If the pool is filled by a home connection, the sewer charge will not be waived unless the connection has a village approved deduct meter.
(F) Home owners may purchase or rent a sewer deduction meter from the village. Work shall be inspected and approved by the Water Department Superintendent.
(G) (1)
A fee for bulk water taken by tanker truck or similar conveyance for non-emergency use will be based on the village normal water rates for 10,000 gallons per load.
(2) The fee collected shall be paid to the Village Water Department through the Utility Office on a weekly basis.
(3) A sheet listing the date, name, address, and number of loads will accompany the payment to Utility Office.
(4) No non-emergency use of the village’s bulk water shall extend outside the village corporate limits.
(5) Fire hydrants shall not be opened for the purpose of providing non-emergency bulk water without first contacting the Village Water Department and hydrants shall be opened only by Village Water Department personnel.
(H) Sale of bulk water with Village Fire Department delivery. No individual or organization, with the exception of the Village Fire Department, shall attempt to take water from an unmetered receptacle without the direction from the Water Department Superintendent:
(1) Rates - bulk water.
(a) A fee for bulk water taken by tanker truck for non-emergency (i.e. to fill a pool) use will be:

(b) A premium charge of 10% shall be added to the purchase of bulk water by a nonresident of the village on the water only.
(2) Quantity. Quantity will be based on:
(a) The amount dispensed by the Fire Department (tanker holds 3,000 gallons);
(b) By fire hose from a hydrant, which shall be metered. Fire hydrants shall not be opened for the purpose of providing non-emergency bulk water without first contacting the Village Water Department and hydrants shall be opened only by Village Water Department or designated Fire Department personnel;
(c) By a home connection. If the pool is filled by a home connection, the sewer charge will not be waived unless a village employee observes the meter reading immediately before and immediately after the pool is filled; or
(d) Based on the total volume of the pool, even if the pool is partially filled prior to being filled by the village.
(3) Deliver charge. For bulk water delivered by tanker truck by the Fire Department, there will be an additional charge of $125.00 per load. The Brewster Fire Association will receive the delivery charge.
(4) Collection of fees. The fees collected shall be paid to the Village Water Department through the Utility Office. If delivered by the Fire Department, the Fire Department will forward the date, name, address, and number of loads to the Utility Office.
(5) Bulk water purchase process for Fire Department delivery. The following steps shall be observed for any bulk water purchases that includes the delivery of the bulk water by the Village Fire Department:
(a) Resident/customer makes request and completes form with the Utility Office.
(b) Utility Office takes information and forwards information to the Fire Department.
(c) Fire Department delivers bulk water within seven days, if personnel are available.
(d) Fire Department notifies Utility Office that delivery is complete, and updates information (i.e. number of gallons/trips).
(e) Utility Office finalizes bill and bills resident/customer.
(f) Utility Office applies resident/ customer payment to:
1. Pay for water;
2. Pay wages for village employee (i.e. Fire Department); or
3. "Donation" to Fire Department Association.
(I) Rates; water delivery by hydrant. No individual or organization, with the exception of the Village Fire Department, shall attempt to take water from an unmetered receptacle without the direction from the Water Department Superintendent.
(1) Rates; water delivery by tanker truck.
(a) Individuals and organizations may take delivery of bulk water by Fire Department tanker truck. The cost shall be as follows:
1. Individuals or organizations, with the exception of the Fire Department, who take delivery of water by Fire Department tanker truck shall pay a flat fee of $125 per load.
2. The flat fee per Fire Department tanker truck load shall be distributed as follows:
a. The bulk fee for water set forth below times the amount dispensed by the Fire Department (tanker holds 3,000 gallons) shall be paid to the Water Department Fund.
b. The fee for bulk water taken by tanker truck for non-emergency (i.e. to fill a pool) use will be as follows per thousand gallons:

c. The amount of $90, from the $125, shall be distributed to the Brewster Fire Association as a donation.
d. The remaining amount shall be distributed to the Fire Department Wage Fund to pay the wages of the individual(s) from the Fire Department who deliver the bulk water by Fire Department tanker truck.
(b) A premium charge of 10% ($12.50) shall be added to the purchase of bulk water by a non-resident of the village.
(2) Rates; water delivery from hydrant. Individuals and organizations may take delivery of bulk water by fire hose from a hydrant, which shall be metered. Fire hydrants shall not be opened for the purpose of providing non-emergency bulk water without first contacting the Village Water Department. Hydrants shall be opened only by Village Water Department or designated Fire Department personnel. The cost shall be as follows:
(a) 1. Individuals or organizations, with the exception of the Fire Department, who take delivery of water from a fire hydrant shall pay for the water used at the bulk rate set forth below based on the amount of gallons registered on the village's hydrant meter.
2. The fee for bulk water for non-emergency (i.e. to fill a pool) use will be as follows per thousand gallons:

(b) In addition, the individual or organization shall also pay for the wages of the village personnel who set up and provide the water from a hydrant.
(c) In addition to the water and wage costs, the individual or organization shall also pay the amount of $90, which shall be distributed to the Brewster Fire Association as a donation.
(3) Rates; water delivery from household spigot/faucet. Individuals and organizations may take delivery of bulk water by a home connection (i.e.
spigot or faucet). If the pool is filled by a home connection, the sewer charge will not be waived unless a village employee observes the meter reading immediately before and immediately after the pool is filled.
(4) Collection of fees.
(a) The fees collected shall be paid to through the Utility Office.
(b) If bulk water is delivered by the Fire Department, the Fire Department will forward the date, name, address, and number of loads to the Utility Office.
(5) Bulk water purchase process.
(a) Resident/customer makes request and completes form with the Utility Office.
(b) Utility Office takes information and forwards information to Fire Department.
(c) Fire Department delivers bulk water within seven days, if personnel are available.
(d) Fire Department notifies Utility Office that delivery is complete, and updates information (i.e. number of gallons/trips).
(e) Utility Office finalizes bill and bills resident/customer.
(f) Utility Office applies resident/ customer payment to:
1. Pay for water;
2. Pay wages for village employee (i.e. Fire Department); or
3. "Donation" to Fire Department.

Any water customer that is outside of the corporation limits of the village shall pay an additional surcharge of 15% on the water usage rates, capital charges, and monthly minimums specified in § 53.16(A), (B) and (C).

Where more than one dwelling unit is served through a single water meter, for billing purposes, each rate step, including usage rates, service and capital charges, and similar fees or charges, shall be multiplied by the number of dwelling units served through the one meter. The village reserves the right to require all future multiple dwelling units or apartments to be individually metered and plumbed before service is established.

For all water and sewer utility services, the current property owner of record of the land involved is responsible for all water and sewer bills, irrespective of who incurs such unpaid bills or when such bills are incurred or who owned or occupied the property at the time such bills were incurred. Such unpaid water and/or sewer bills may be assessed as a tax lien against the property involved. Without relieving the property owner of his responsibility for payment of all water and sewer bills, the village reserves the right to require a suitable deposit to secure payment of water and sewer bills.
