713.01 PERMIT REQUIRED.

   No person, being the owner or occupant or in control or having the management of any residential parcel of real property located within the City, shall hold or conduct or permit to be held or conducted upon such property the sale of any household goods, equipment, utensils, appliances, personal clothing or effects or other similar personal property unless a permit has been granted therefor and the sale is conducted in accordance with the provisions of this chapter. A permit shall not be required where six items or less are offered for sale.

713.02 APPLICATION AND ISSUANCE.

   Permits shall only be issued by the Building Commissioner to a resident of the City or his or her agent, who agrees to comply with the provisions of this chapter, including

   (a)   Giving the name and permanent address of the applicant and of any person assisting in the public sale and the name and address of the principal person for whom the sale is being held;

   (b)    Giving a full and complete itemized list of all of the property to be sold and an estimate of its sale value;

   (c)    Paying the required permit fee;

   (d)    Stating in writing that, as a condition of the permit, any law enforcement official of the City may enter upon the premises where the sale is being held during the sale hours to verify that the sale is being held in accordance with the application, with the permit and with the laws of the City; and

   (e)    If the sale is to be held in a condominium unit, providing a letter from an officer or agent of the condominium association approving the application.

713.03 TRAFFIC SUPERVISION; INVESTIGATION.

   A copy of the application and permit shall be delivered to the Chief of Police so that traffic may be supervised, if necessary, and so that he or she may assign a police officer to verify that the sale is being held in accordance with this chapter.
