The following deletions, modifications and amendments to the county ordinance shall be effective and applicable to the village:
Section 18-12 (Definitions) is amended by:
(1) Deleting the definition for "committee" in its entirety, and replacing it with the words the "oversight committee of the village which shall be comprised of the public works director, the director of community development and the assistant to the village administrator, who are hereby appointed and designated as the oversight committee of the village for purposes of this chapter."
(2) Deleting the definition of "department" in its entirety, and replacing it with the words "the village engineer".
(3) Deleting the definition of "director" in its entirety, and replacing it with the words "the village engineer".
(4) Adding the following to the list of definitions: "Village: The village of Bartlett, an Illinois home rule municipal corporation of DuPage, Cook and Kane Counties, Illinois."
Section 18-21 (Applicability) is amended by deleting the word "department" and replacing it with the word "village".
Section 18-22 (Interpretation) is amended by deleting the word "county" and replacing it with the word "village".
Section 18-31 (Participating Communities) is amended by deleting the word "department" in paragraphs 1b, 1c and 1e, and replacing it with the words "DuPage County stormwater management division".
Section 18-33 (Duties Of Director) is amended by deleting the word "communities" in paragraph 3, and replacing it with the words "DuPage County stormwater management committee".
Section 18-34 (Representative Capacity) is amended by deleting the word "county", and replacing it with the word "village".
Section 18-42 (Prohibitions Of Illicit Connections) is amended by deleting the word "department" in the last sentence of paragraph 5, and replacing it with the words "DuPage County stormwater management committee".
Section 18-50 (Submission Of Notice Of Intent (NOI) To The Department) is amended by deleting the word "department" in the subtitle and in paragraphs 1, 2 and 3, and replacing it with the words "DuPage County stormwater management committee".
Section 18-56 (Notification Of Spills) is amended by deleting the word "department" in paragraph 1b, and replacing it with the words "DuPage County stormwater management committee".
Section 18-62 (Notice To Correct Violations; Director May Take Action) is amended by deleting the words "county of DuPage" from paragraph 2 and replacing them with the words "village of Bartlett".
Section 18-66 (Fines) is hereby deleted in its entirety, and the following is substituted therefor:
In addition to all other remedies provided for in article 8 of the county ordinance, any person who violates any provisions of this chapter shall, upon conviction, be subject to a fine of not less than $75.00 and not more than $1,000.00, and each and every day or portion of a day during which the violation is committed, continued or permitted shall constitute a separate offense and shall be punishable by such a fine.
Section 18-86 (Right Of Appeal) is amended by:
(1) Deleting the words "stormwater committee of the DuPage County board" from paragraph 1, and replacing them with the words "oversight committee of the village".
(2) Deleting the words "stormwater committee" from paragraph 3, and replacing them with the words "oversight committee of the village".
(3) Deleting the word "committee" from paragraphs 3 and 4, and replacing it with the words "oversight committee of the village".
(4) Deleting the words "county board" from paragraphs 3 and 4, and replacing them with the words "village president and board of trustees".
