7-2-9: RIGHT-OF-WAY CLEARANCE OF PRIVATE TREES:
Every owner of a privately owned tree overhanging any street, sidewalk, public right-of-way, or Village owned property within the Village shall prune the branches so that such branches shall not obstruct the view of any street light or street intersection, and so that there shall be a clear space of eight feet (8') above the surface of the sidewalk and fifteen feet (15') above the street. The owners of said privately owned trees which overhang any street, sidewalk, or public right-of-way shall remove all dead, diseased, or dangerous privately owned trees, or broken or decayed limbs which constitute a menace to the safety of the public. The Village, in accordance with applicable law, shall have the right to prune any private tree or shrub on private property when it interferes with the proper spread of light along the street from a street light, interferes with visibility of any traffic control device or sign, or is an immediate threat to the safety of the public.
