3-30-3: STANDARD FOR DETERMINING ISSUANCE OF LICENSE:
An ice cream vendor license shall be issued to the applicant by the village clerk unless the village clerk finds, on the basis of the application and reports submitted by the chief of police or his respective designees, that:
   A.   Any fraud, misrepresentation, or false statement contained in the application for such ice cream vendor license; or
   B.   Based on the entry of a final, unappealable order by any court, administrative agency, or hearing officer finding that the applicant or other person or entity described in section 3-1-3 of this title and/or any "vehicle operator" defined in section 3-30-1 of this chapter:
      1.   Is guilty of any felony and/or misdemeanor involving moral turpitude, including, but not limited to, the following: contributing to the delinquency of a child pursuant to section 2a of the neglected children offense act 1 ; contributing to the criminal delinquency of a juvenile pursuant to 720 Illinois Compiled Statutes 5/33D-1; selling, giving or delivering alcoholic liquor to any person under the age of twenty one (21) years in violation of the liquor control act of 1934 2 or the Illinois criminal code of 1961 3 or applicable ordinance; and/or any disqualifying criminal offenses of public act 91-0598 and/or public act 93-0224 copies of which are attached to ordinance 2005-51 as exhibit B and incorporated herein (the "disqualifying criminal offenses"); or
      2.   Has been engaged in acts constituting a nuisance in fact; or
      3.   Has been engaged in acts constituting a nuisance per se as enumerated in Illinois statutes or this code; or
      4.   Has been engaged in acts constituting a danger to the public, health, safety or morals; or
      5.   Has violated the consumer fraud laws of the state of Illinois, or any other state, or of the United States; or
      6.   Has engaged in a business or profession in defiance of the state statute or local ordinance regulating or prohibiting the same, which includes, but is not limited to, the following:
         a.   Prostitution; or
         b.   Gaming operations; or
         c.   Sale of narcotics; or
         d.   Dealing in stolen property; or
         e.   Practicing in a profession without proper certification; or
      7.   Has violated any of the provisions of sections 3-1-10 or 3-1-12 of this title; or
      8.   Has been found to have violated any substantially identical provision of the ordinance of any other municipality by the final, unappealable order of any court, hearing officer or administrative agency.
   C.   Any failure to comply with the requirements of this chapter. (Ord. 2005-51, 5-17-2005)
