Class K licenses, which allow a licensee who holds a class A, A extended, B, and/or F liquor license that has been issued by the village of Bartlett local liquor control commissioner (the "local liquor control commissioner") to sell and offer for sale alcoholic liquor, at retail, for use and consumption off the premises for which said class A, A extended, B, and/or F liquor license has been issued, as an incidental part of food services; provided that such sales are provided by caterers, as defined below, and are limited to guests and invitees at catered functions, subject to the restrictions set forth below: (Ord. 2008-88, 9-2-2008; amd. A. Hours Of Operation:
1. Not to exceed eight (8) hours within a period of twenty four (24) consecutive hours;
2. Within the following time limits:
Sunday, Monday, Tuesday, Wednesday, Thursday | From 8:00 A.M. until 1:00 A.M. |
Friday and Saturday | From 8:00 A.M. until 2:00 A.M. |
3. Within the time limits imposed by any applicable state statute. (Ord. 2008-88, 9-2-2008)
B. License Fees: See section 3-1-1 of this title. (Ord. 2013-79, 10-1-2013)
C. Number Issued: The number of class K licenses shall be limited to 2. (Ord. 2013-62, 8-20-2013)
D. Definitions: For the purpose of this section, "caterer" shall mean and include a person or entity licensed by the village of Bartlett to operate a "catering service", as defined in section 3-1-2 of this title, within the corporate limits of the village.
E. Insurance: Licensee must furnish evidence that licensee's liquor liability insurance coverage required under section 3-3-6 of this chapter and any additional liquor liability and/or dramshop insurance coverages required by statute provides coverage for liability arising out of the sale and/or consumption of alcoholic liquor pursuant to the class K liquor license. Licensee shall comply with the liquor license and additional insured endorsement requirements set forth in said section 3-3-6 of this chapter. (Ord. 2008-88, 9-2-2008)
F. Limits On License: A class K liquor license shall only be issued to caterers, as defined above, who operate their catering business from the same premises for which their class A, A extended, B, and/or F liquor license and catering service license have been issued and shall only be valid for catered functions located within the corporate limits of the village in connection with the catering of foods. G. BASSET Certification: A class K liquor license holder shall at all times cause the sale, offer for sale, and/or serving of alcoholic liquor pursuant to said class K liquor license to be performed exclusively by persons who have received a beverage alcohol sellers and servers education and training (BASSET) certification from an entity that has obtained a BASSET license from the Illinois liquor control commission. H. State Caterer Retailer License: A class K liquor license holder shall file a copy of its caterer retailer license issued by the Illinois liquor control commission ("state caterer license") with the village clerk within thirty (30) days of issuance of the class K license to said class K liquor license holder by the local liquor control commissioner and shall not engage in any sale or offer for sale of alcoholic liquor, at retail, in connection with any catered function within the corporate limits of the village of Bartlett without holding and maintaining both a village class K liquor license and a state caterer license.
