The city shall have the power to regulate the use of all streets, alleys, sidewalks, and other public grounds and property within the city; and to that end, no person shall place any obstructions or other encroachments on the same, nor shall any person injure the same in any manner, nor shall any person deface, draw on, write on, or otherwise place any mark on, whether temporary or permanent, any such street, alley, sidewalk, or other public ground or property, nor shall any person engage in any practice thereon which may have a tendency to annoy any other person frequenting or using the same; unless prior specific approval has been obtained from the City Council therefor.

(A) Designation of lots to be assessed. Pursuant to SDCL § 9-43-138, all lots in the city fronting a street shall be assessed on the front foot basis.
(B) Amount of assessment. There shall be levied upon all lots fronting a street $0.90 cents per front foot. Front foot means the actual front foot of the premises as established by the buildings thereon, record title and use of the property regardless of the original plat.
(C) Assessment. The City Finance Officer is directed to add such assessment to the general assessment against the property and certify the assessment together with the regular assessment to the county auditor to be collected as municipal taxes for general purposes.
(D) Assessment subject to review. The assessment is subject to review and equalization the same as assessments or taxes for general purposes.

SNOW REMOVAL
For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.
STREET. The entire width of any public roadway within the city and it shall not be limited to those roadways designated as a STREET, but includes avenues, boulevards, and all other names by which public roadways are designated.

The duties of owners, tenants, or persons in possession of any property are as follows:
(A) Sidewalks. It shall be the duty of the owner, tenant, or person in possession of any property abutting on any sidewalk to keep such sidewalk free from snow and ice and to remove or cause to be removed all accumulation of snow or ice within 24 hours after every fall or accumulation of snow or ice.
(B) Sidewalks ending at intersection or crosswalk. It shall be the duty of the owner, tenant, or person in possession of any property abutting upon any sidewalk which ends at an intersection or crosswalk to remove or cause to be removed all accumulation of snow or ice within 24 hours after every fall or accumulation of snow or ice. Snow and ice deposited on the sidewalk in the street removal process shall be removed within 24 hours of being deposited.
(C) Mailboxes. It shall be the duty of the property owner, tenant, or person in possession of any property upon which any mailbox is affixed to keep the immediate area around such mailbox free from snow and ice in such a manner so as not to obstruct or interfere with the delivery or collection of the United States mail, and to remove or cause to be removed all accumulation of snow or ice within 24 hours after every fall or accumulation of snow or ice. Snow and ice deposited around any mailbox in the street removal process shall be removed within 24 hours of being deposited.
(D) Fire hydrants. It shall be the duty of the property owner, tenant, or person in possession of any property upon which any fire hydrant is affixed to keep the immediate area around such fire hydrant free from snow and ice in such a manner so as not to obstruct or interfere with access to the fire hydrant, and to remove or cause to be removed all accumulation of snow or ice within 24 hours after every fall or accumulation of snow or ice. Snow and ice must be removed from at least a three-foot radius around any fire hydrant, and at least a two-foot wide path must be cleared between the fire hydrant and the nearest city street. Snow and ice deposited around any fire hydrant in the street removal process shall be removed within 24 hours of being deposited.
(E) Sanding sidewalks. In the event that snow or ice on a sidewalk have become so hard that such accumulation cannot be removed without the likelihood of damage to the sidewalk, the owner, tenant, or person in possession charged with the removal of such accumulation shall, within 24 hours, cause enough sand or other abrasive to be put on the sidewalk to make travel thereon reasonably safe and shall then, as soon thereafter as weather permits, remove or cause to be removed all accumulation of snow or ice within 24 hours.

The city shall provide notice on the official city website that each owner, tenant, or person in possession is required to keep the sidewalk in front of the premises free and clear from snow and ice. It shall state that if the owner, tenant, or person in possession fails to remove the snow or ice within 24 hours of the falling or accumulation hereof, that the city may cause said snow or ice to be removed and charge the cost to the abutting property.

If the owner, tenant, or person in possession of property fails to remove the snow or ice from the sidewalks within the time specified, any authorized officer of the city, as designated by the Mayor, may issue a citation for such violation and the City Council may authorize such removal with the costs to be assessed against the abutting property.
