(a) (1) A certificate of use and occupancy, issued by the Building Inspector, is required prior to the occupancy and/or use of a building hereafter erected, a building or structure hereafter altered so as to affect the front, side or rear yards or the useable square footage thereof or a change in the use of a premises. No land, building or structure, or part thereof, hereafter erected or altered in its use or structure shall be occupied and/or used until a final inspection has been made and all violations found during such inspection have been corrected and reinspected, and the Building Inspector has issued a certificate of use and occupancy stating that such land, building or structure, or part thereof, and the proposed use thereof, are found to be in conformity with this Building Code, the Planning and Zoning Code and other applicable rules and ordinances.
(2) Within three working days after notification that a building, structure or premises, or part thereof, is ready for occupancy and/or use, the Building Inspector shall cause to be made a final inspection thereof and issue a certificate of use and occupancy if the land, building or structure, or part thereof, and the proposed use thereof, are found to be in conformity with all applicable codes and ordinances.
(3) Upon request from the responsible party to the Public Works Department, any inspection of required swales and finish grades will be made prior to the issuance of a certificate of occupancy.
(4) If a finish grade cannot be maintained at the time of final inspection for occupancy because of frozen ground or other weather conditions, a temporary certificate of occupancy may be issued for a reasonable amount of time, providing a notarized signed statement by the general contractor and the party desiring to occupy the structure, attesting to the fact that they are aware that prosecution by the City may be forthcoming if the final grading is not complete prior to the expiration of the temporary certificate of occupancy.
(b) Such certificate of use and occupancy shall be issued only after all applicable Municipal fees are paid. Any occupancy and/or use prior to the issuance of a certificate of use and occupancy shall be deemed to be a violation of this section.
(c) Any lot or land in the City required to have sidewalks installed pursuant to Chapter 1010 of these Codified Ordinances, or to have sidewalks installed or repaired as provided in Section 660.05 of these Codified Ordinances, shall have such sidewalks installed or repaired in conformity with the specifications of the Public Works Department and shall be inspected by the same prior to the issuance of a certificate of use and occupancy.
(d) Any lot or land in the City on which sewers, drains and/or pavement have been placed shall have such sewers, drains and/or pavement installed in conformity with specifications required by the Public Works Department and/or the Department of Municipal Utilities, inspections of same made by the appropriate department and all associated Municipal fees paid prior to the issuance of a certificate of use and occupancy.
(e) Any and all damage caused to any adjoining property by a general contractor, subcontractor or owner, and/or agents, servants and/or employees thereof, shall be restored and/or repaired to the satisfaction of the Building Inspector prior to the issuance of a certificate of use and occupancy.
