Section 830.01 shall not be construed to prohibit the use of the waters of Lake Erie or the soil beneath such waters by members of the public for purposes of navigation and fishing, or the reasonable use thereof by littoral or shoreline owners, the rights of whom are recognized by general law, or the construction, operation, maintenance and use of piers, docks, wharves and other encroachments under lease from the City as provided by Ohio R.C. 721.04.
