   (a)   Except as otherwise set forth in a collective bargaining agreement or the Rules of the Civil Service Commission, as applicable, the tenure of every officer (sworn or non-sworn) or employee in the classified service of the City shall be during good behavior and efficient service, but any such employee may be removed or disciplined for incompetency, inefficiency, dishonesty, drunkenness, immoral conduct, insubordination, discourteous treatment of the public, neglect of duty, violation of the ordinances of the City or laws of the State or of the United States, or of the rules of the Civil Service Commission, other failure of good behavior or any act of misfeasance, malfeasance or nonfeasance in office.
   (b)   Nothing in this chapter shall be construed to limit the right of the City to lay off or separate from the service any officer (sworn or non-sworn) or employee if any position becomes unnecessary and is abolished or by reason of lack of funds.
