§ 97.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   PARADE. Any parade, march, ceremony, show or procession of any kind, exhibition or any similar display, in or upon any street, sidewalk or other public place in the city.
   PARADE PERMIT. A written authorization as required by this chapter.

§ 97.02 EXCEPTIONS TO CHAPTER.
   This chapter shall not apply to:
   (A)   Funeral processions.
   (B)   Students going to and from school classes or participating in educational activities where any such activity is under the immediate supervision and direction of proper school authorities.
   (C)   A governmental agency acting within the scope of its functions.

§ 97.03 PERMIT REQUIRED.
   (A)   No person shall engage or participate in, aid, form, start or direct any parade unless a permit shall have been obtained from the City Manager.
   (B)   A violation of this section is punishable as a misdemeanor.

§ 97.04 APPLICATION FOR PERMIT.
   (A)   Filing period. An application for a parade permit shall be filed with the City Manager not less than 14 days before the time when it is proposed to conduct the parade; provided, that a permit may be issued if filed less than 14 days before the time for commencement of the parade when the City Manager finds that adequate provision can be made to handle such parade within the period between the filing of application and time for commencement of the parade.
   (B)   Contents. The application for a parade permit shall set forth the following information:
      (1)   The name, address and telephone number of the person seeking to conduct such parade;
      (2)   If the parade is proposed to be conducted for, on behalf of, or by an organization, the name, address and telephone number of the headquarters of the organization, and of the authorized and responsible heads of such organization;
      (3)   The name, address and telephone number of the person who will be the parade chairman and who will be responsible for its conduct;
      (4)   The date when the parade is to be conducted;
      (5)   The approximate number of persons who, and vehicles which, will constitute such parade and description of the vehicles;
      (6)   The hours when such parade will start and terminate;
      (7)   A statement as to whether the parade will occupy all or only a portion of the width of the streets and sidewalks proposed to be traversed;
      (8)   The location by streets of any assembly area and the proposed route for such parade;
      (9)   The time at which units of the parade will begin to assemble at any such assembly area or areas;
      (10)   The interval of space to be maintained between units of such parade;
      (11)   If the parade is designed to be held by and on behalf of, or for, any person other than the applicant, the applicant for such permit shall file with the city manager a communication in writing from the person proposing to hold the parade, authorizing the applicant to apply for the permit on his behalf;
      (12)   Any additional information which the City Manager shall find reasonably necessary to a fair determination as to whether a permit should be issued.

§ 97.05 STANDARDS FOR ISSUANCE.
   The City Manager shall issue a permit as provided hereunder when, from a consideration of the application and from such other information as may otherwise be obtained, he finds that:
   (A)   Adequate provision can be made for the safe and orderly movement of the parade and of other traffic contiguous to its route;
   (B)   Adequate provision can be made for police protection which will not require the diversion of so great a number of police officers of the city to police properly the line of movement and the area contiguous thereto as to prevent normal police protection to the city.
   (C)   The activity will not interfere with the right of property owners in the area to enjoy peaceful occupancy and use of their property.
   (D)   The activity can be conducted without unreasonable interference with normal vehicular or pedestrian traffic in the area and will not prevent normal police or fire protection to the public and will not be likely to cause injury to persons or property or provoke disorderly conduct or create a public disturbance.

§ 97.06 ACTION ON PERMIT BY CITY MANAGER.
   The City Manager shall act upon the application for a parade permit within 48 hours after the filing thereof. If the City Manager disapproves the application, he shall notify the applicant stating the reason for his denial of the permit.

§ 97.07 REVOCATION OF PERMIT; DISPERSAL OF PARADE.
   Upon the violation of any of the terms of the permit by any person participating in the parade, any police officer of the city is authorized to then revoke the permit and direct those participating in the parade to disperse.

§ 97.08 AUTHORIZED HOURS.
   No person may conduct or otherwise participate in any parade except between the hours of 9:00 a.m. to 11:30 a.m., 1:00 p.m. to 3:00 p.m., and 4:30 p.m. to 9:00 p.m., Monday through Saturday.
