9-1-1: SHORT TITLE:
This title is cited as and referred to as the ZONING ORDINANCE or the ZONING ORDINANCE OF THE CITY OF ARTESIA. (Ord. 1028, 8-28-2018)
9-1-2: PURPOSE:
This title is enacted for the purpose of promoting the health, safety, morals, convenience, orderly prosperity and welfare of the present and future inhabitants of the City by lessening of congestion in the streets and roads; securing safety from fire and other danger; providing adequate light and air; the classification of land uses and the distribution of land development and utilization; avoiding undue congestion of population; facilitating the adequate provision of transportation, water, schools, sewerage and other public requirements; and by other means in accordance with the comprehensive plan, and the zoning map adopted herewith. 9-1-3: INTERPRETATION; COMPLIANCE WITH PROVISIONS:
   A.   Interpretation: In interpreting and applying the provisions of this title, they shall be held to be the minimum requirements for the promotion of the public safety, health, convenience, comfort, morals, prosperity and general welfare. It is not intended by this title to interfere with or abrogate or annul any easements, covenants or other agreements between parties; except, that if this title imposes a greater restriction, this title shall control.
   B.   Compliance Required: The use of premises and all buildings in the City shall be in accordance with the minimum standards established in this title. (Ord. 1028, 8-28-2018)
9-1-4: BUILDINGS AND LOTS:
Every building shall be on a lot, and accessory buildings shall not be placed on a lot without a main building occupying the same lot. (Ord. 1028, 8-28-2018)
9-1-5: MULTIPLE USE; REDUCTION OF LOT AREAS:
Yards, number of parking spaces or lot area required for one main building cannot be used for another main building, nor can the size of a lot be reduced below the requirements of this title unless a variance is approved in accordance with the provisions of chapter 13 of this title. 9-1-6: SIGHT TRIANGLE REQUIREMENTS:
In all districts, and except as cited below, no obstruction to view in excess of three feet (3') in height, including, but not limited to, buildings/structures, driveways and parking spaces (where a parked vehicle or vehicles would be a visual obstruction), fences/walls, landscaping and associated design features (berms, boulders, decorative lighting, statues, etc.) and signs, shall be placed in the following areas:
   A.   On any corner lot/parcel within a triangle formed by street property lines and a line connecting them at points twenty feet (20') from the intersection of the street property lines.
   B.   On any lot/parcel within a triangle formed by a newly platted alley line and a street property line and a line connecting them at points ten feet (10') from the intersection of the newly platted alley line and street property line.
   C.   On any lot/parcel within a triangle formed by a driveway line and street property line and a line connecting them at points ten feet (10') from the intersection of the driveway line and street property line, on both sides of the driveway.
Street light poles, traffic control signal poles, traffic regulating signs and utility poles (but not utility boxes or pedestals) that exceed three feet (3') in height may be located in the sight triangle areas if they are placed in a manner that permits unobstructed vision to pedestrians and vehicle drivers.

9-1-7: DRIVEWAY LOCATION REQUIREMENTS:
In all districts, the location of driveways on a lot/parcel shall be placed in a manner that provides safe ingress and egress, taking into account both vertical sight distance (determining visual obstructions extending vertically from property and adjoining street right-of-way grades) and horizontal sight distance (determining visual obstructions due to changes in street grade elevations). A driveway shall not be placed within twenty feet (20') of an intersection of street property lines unless a variance is approved in accordance with the provisions of chapter 13 of this title. 9-1-8: BUILDING PLACEMENT AND STORMWATER REQUIREMENTS:
In all districts, and regardless of whether there are no setback requirements in some districts, and regardless of any setback encroachment allowances, the following building placement and stormwater requirements shall apply:
   A.   The roof of a building shall not project across a property line.
   B.   Stormwater runoff from the building shall not run onto an adjacent property.
   C.   No building shall be placed over any drainage or utility easement.
   D.   All other provisions of this title and applicable Building and Fire Codes regarding buildings shall be adhered to. (Ord. 1028, 8-28-2018)
