Permits for fireworks display shall be issued by the Mayor after the Mayor or his or her designee have inspected the display site and determined that the displays shall be in full compliance with the rules of the State Fire Marshal, which shall be based upon nationally recognized standards such as those of the National Fire Protection Association 1123 guidelines for outdoor displays and National Fire Protection Association 1126 guidelines for indoor displays and shall not be hazardous to property nor endanger any person or persons. The original permit shall be sealed by the Village Clerk and kept in possession of the supervising person, one copy of each permit shall be kept on file at the village office. No fireworks display permit issued hereunder shall be transferable.

(A) Any person, firm or corporation who discharges or displays fireworks without a display permit shall, upon conviction thereof, be subject to a fine of not less than $75 nor more than $750.
(B) Any person, firm or corporation who transfers or sells fireworks to a person without a display permit, shall be subject to a fine of not less than $75 nor more than $750.
(C) Each transfer or sale of fireworks to a person lacking a display license, or each use or display of fireworks without a display permit constitutes a separate offense. In addition, any person found guilty of illegal transfer, sale or display of fireworks shall be ineligible for a village fireworks display permit for a period of five years.
