§ 94.01 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CONSUMER FIREWORKS. Refers to fireworks which were formerly classified as Class C common fireworks and are now classified as Fireworks UN0336, 1.4G under the regulations of the U.S. Department of Transportation.
   FIREWORKS.
      (1)   The same as in the Illinois Fireworks Use Act, ILCS Ch. 425, Act 35, § 1, which, as of the effective date of the ordinance codified in this chapter, is as follows: the term FIREWORKS shall mean and include any explosive composition, or any substance or combination of substances, or article prepared for the purpose of producing a visible or audible effect of a temporary exhibitional nature by explosion, combustion, deflagration or detonation, and shall include blank cartridges, toy cannons, in which explosives are used, the type of balloons which require fire underneath to propel the same, firecrackers, torpedoes, skyrockets, Roman candles, bombs or other fireworks of like construction and any fireworks containing any explosive compound, or any tablets or other device containing any explosive substance, or containing combustible substances producing visual effects: provided, however, that the term FIREWORKS shall not include snake or glow worm pellets; smoke devices; trick noisemakers known as "party poppers", "booby traps", "snappers", "trick matches", "cigarette loads" and "auto burglar alarms"; sparklers; toy pistols, toy canes, toy guns or other devices in which paper or plastic caps containing twenty-five hundredths grains or less of explosive compound are used, providing they are so constructed that the hand cannot come in contact with the cap when in place for the explosion; and toy pistol paper or plastic caps which contain less than twenty hundredths grains of explosive mixture; the sale and use of which shall be permitted at all times.
      (2)   Should the state legislature change the definition of "fireworks" in the Fireworks Use Act, then the definition contained in this chapter shall be deemed to be amended in conformance with the definition in state law.

§ 94.02 PROHIBITION OF FIREWORKS SALES AND DISPLAY.
   Except as permitted by this chapter, the transfer, sale, use or display of fireworks within the corporate limits of the village is prohibited.

§ 94.03 DISPLAY PERMITS.
   Any not-for-profit group of three or more persons may obtain a fireworks display permit for consumer fireworks by complying with the following procedures:
   (A)   At least one member of the group shall be a resident of the village;
   (B)   All members of the group shall be 18 years of age or older; and
   (C)   At least three members of the group shall sign an application form provided by the village which will contain the following information, as a minimum:
      (1)   The name, address and telephone number of the members of the group applying for the license;
      (2)   The date, time and location of the fireworks display for which a permit is sought; and
      (3)   The name, address and telephone number of the person who will supervise the fireworks display, together with evidence that the person is licensed by the state as a lead pyrotechnic operator.

§ 94.04 APPLICATION FEE.
   At the time of making application, the group shall submit a license application fee in the amount of $5, which shall be nonrefundable.
