For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
BUILDING PERMIT: A permit issued by the village for the construction of public improvements and site grading.
CONSTRUCTION AREA: The area on a development site where earthmoving is contemplated for the construction of public improvements including extended grading areas.
dbh: The diameter of a tree measured at breast height, or four feet six inches (4'6") above the ground.
dbh CATEGORIES: Category 1, trees with a dbh of 10 inches to 19.9 inches
Category 2, trees with a dbh of 20 inches to 29.9 inches
Category 3, trees with a dbh of 30 inches or greater
DEVELOPER: A person applying for plan approval and/or building permit for a new subdivision or new planned unit development.
DRIP LINE: The area under a tree determined by measuring the longest horizontal branch of that tree and using that measurement as the radius and the trunk as the center, the circular area of land under the tree is defined as within the drip line.
EXTENDED GRADING AREAS: The public rights of way and those areas extending beyond the rights of way and easements for public improvements where, in keeping with accepted engineering practices, grading should be extended beyond such road rights of way and easements. Should the extended grading areas extend beneath the drip line of any healthy mature tree, then that tree shall be included in the number of trees to be replaced regardless of its chance of survival. Any healthy mature tree designated for replacement due to an extended grading area shall be given all possible chance for survival at the developer's/owner's expense. Extended grading areas shall not be granted for the sole purpose of placing buildings on individual lots. Easements not included in the extended grading areas where trees remain shall be excluded from the tree replacement requirements of this chapter.
MATURE TREE: Any tree with a dbh of ten inches (10") or greater.
OWNER: Joint tenancies, trusts, beneficiaries under wills and trusts, corporation, partnership, sole proprietorship, lessors, lessees, agents, executors, assigns and the like.
PARCEL: All contiguous land in one ownership.
REPLACEMENT TREES: Any tree not listed in subsection 8-6-4C of this chapter, or "wildlife planting" as defined in this section.
RIGHT OF WAY: Those areas dedicated to the village which may include streets, roads, boulevards, curbs, gutters or sidewalks.
SITE DEVELOPMENT: The altering of the terrain, removal of trees and/or vegetation and construction of public improvements thereon including the extended grading areas.
SITE DEVELOPMENT PLAN: The final plan of subdivision or planned unit development (PUD), showing the public improvements including any extended grading areas.
VILLAGE: The village of Antioch, Lake County, Illinois.
WILDLIFE PLANTING: One clustered planting of the following: one white pine; one burr oak; one gray dogwood; one black cherry; one American plum or any species recommended by the Illinois department of conservation. Wildlife plantings are suggested for edging of wetlands and property boundaries to create hedgerows for animal habitat. (1976 Code § 100.03; amd. Ord. 01-10-29, 11-5-2001)
