Wastewater discharge permits shall not be transferred, assigned, or sold to a new owner or new user in different premises or to a new or different operation in the same or different premises without the expressed written approval of the village administrator. If the premises sold or otherwise transferred by the permittee to a new owner who will maintain the operation in the same premises, whether or not the seller will continue to operate the equipment or the equipment is leased to another entity for its operation at the site of the original permittee, then the permit held by the seller and/or owner shall be reissued by the village to the new owner and/or operator as a temporary permit; provided:
A. The new owner and/or operator notified the village administrator thirty (30) calendar days in advance of the transaction; and
B. The new owner and/or operator confirmed to the village administrator, within twenty four (24) business hours of the transaction, of completion of the date of sale or execution of an operating contract; and
C. The new owner and/or operator shall immediately apply for a new permit in accordance with this chapter.
Failure to provide the sale/transfer notification defined in subsection A and B above, renders the wastewater discharge permit void as of said sale/transfer date. It is further provided that the temporary permit shall only be effective for ninety (90) days after the date of sale or transfer. The village shall have the same remedies for violation of temporary permits as it has for violation of other discharge permits. (Ord. 20-08-25, 8-10-2020)
