6-3-1: CURFEW:
   A.   Curfew Hours: It is unlawful for a person less than seventeen (17) years of age to be present at or upon any public assembly, building, place, street or highway at the following times unless accompanied and supervised by a parent, legal guardian or other responsible companion at least eighteen (18) years of age approved by a parent or legal guardian or unless engaged in a business or occupation which the laws of this state authorize a person less than seventeen (17) years of age to perform:
      Between 12:01 A.M. and 6:00 A.M. Saturday;
      Between 12:01 A.M. and 6:00 A.M. Sunday; and
      Between 11:00 P.M. on Sunday to Thursday, inclusive, and 6:00 A.M. on the following day.
It is unlawful for a parent, legal guardian or other person to knowingly permit a person in his custody or control to violate this subsection. (1976 Code § 130.020; amd. 2003 Code)
   B.   Warning To Violator: Any child under the age of eighteen (18) years who shall violate any of the provisions of this section shall be warned by any police officer forthwith to comply with such provisions. Any child who resists such warning shall be brought immediately to the police station. The parent, guardian or other adult person having the legal care and custody of such child shall be notified without delay of the manner in which this section has been violated, and must then come to the police station and take charge of such child. Any police officer finding a violation of this section shall, without delay, report such violation to his superior officer, who shall cause a written notice to be served upon the parent, guardian or other person having the legal care and custody of the child involved.    C.   Court Appearance: In case any child under the age of eighteen (18) years, after receiving a warning as above, shall again violate any of the provisions of this section, the violator and the parent or guardian thereof will be requested to appear before the county court judge of Lake County for disposition. If the parent or guardian and violator do not appear upon such request, the county court judge will then order the sheriff to bring in said persons. (1976 Code § 130.022)
   D.   Penalties: A person convicted of a violation of any provision of this section, and in case any parent, guardian or person having legal custody of a child, who has received notice of a violation as provided herein, shall knowingly permit such child again to violate the provisions of this section, shall be fined pursuant to the schedule of fines set forth in subsection 1-3-1A of this code.
