The Town Clerk-Treasurer, in addition to his or her other duties, is hereby designated as Building Commissioner of the town, with such duties, powers and authority as provided in the Zoning Ordinance and in the subdivision regulations.

(A) Establishment. The Town Council hereby establishes the position of Town Manager. The Town Manager position shall report directly to the Town Council and shall work under its policies, budgets and directives. The Town Manager shall be responsible for the administrative functions of town government and carrying out the will of the Town Council on a day-to-day basis. Exercising appropriate discretion and independent judgment, the Town Manager shall coordinate and direct all town operations, except the operations of the Clerk-Treasurer’s office and the Parks and Recreation Department. The Town Manager shall administer and enforce ordinances, policies, directives and annual budgets of the Town Council.
(B) Employment issues. Except for town employees of the Clerk-Treasurer’s office and the Parks and Recreation Department, the Police Department and the Fire Department, the Town Manager shall approve hiring, termination and other personnel decisions for all town employees in accordance with the town’s salary ordinance and any other policies established by the Town Council. However, the Town Manager may hire or terminate town department managers only after consulting with the Town Council Administrative Committee on such personnel matters and without regard to I.C. 36-5-5-8(3).
(C) Compensation and performance bond. The Town Council shall set the amount of compensation, including benefits, for the Town Manager. The Town Manager’s duties are as set forth in I.C. 5-4-1 and I.C. 36-5-5-5.

(A) Creation of Deputy Mayor. Pursuant to I.C. 36-4-9-7, the Town Council may establish by ordinance the position of Deputy Mayor, who serves as the town's executive deputy. Pursuant to statute, the Deputy is appointed by and serves at the pleasure of the Mayor.
(B) General powers of the Deputy Mayor. The Deputy Mayor shall report directly to the town's executive and shall work under its policies, budgets and directives. The Deputy Mayor shall be responsible for the administrative functions of the town government and carrying out the will of the executive on a day-to-day basis. Exercising appropriate discretion and independent judgment, the Deputy Mayor shall assist with the coordination and direction of all town operations, except the Parks Department. The Deputy Mayor shall assist in the administration and enforcement of ordinances, policies, directives and annual budgets of the Town Council. The Deputy Mayor shall advise the executive in performance of its duties. The Deputy Mayor shall ensure that sufficient staff resources are provided to support the Town Council.
(C) Duties of the Deputy Mayor. The Deputy Mayor shall fulfill the role of Town Manager as that position was previously defined unless expressly modified by this section.
(D) Absence of Mayor. Per the reorganization of the town, if the Mayor has advance knowledge that he or she will be unavailable for more than two business days, the Mayor shall inform the Town Council President in writing of the precise period of unavailability, and the Mayor shall designate the Deputy Mayor or a department head, if the Deputy Mayor is unavailable, to serve as Acting Mayor during that time period.
(E) Performance of technical tasks. The Deputy Mayor shall perform technical tasks, including, but not limited to:
(1) Evaluating proposals, conducting studies, and gathering information;
(2) Assisting in document preparation and recording;
(3) Soliciting bids and executing contracts on behalf of the town for materials, supplies, and services;
(4) Preparing Town Council meeting agendas and attending Town Council meetings;
(5) Attending staff, commissions, and committee meetings as appropriate;
(6) Keeping the executive and Town Council informed of activities and issues; and
(7) Investigating citizen complaints or problems and making recommendations to the executive for changes in policies or ordinances.
(F) Performance of managerial tasks. The Deputy Mayor shall perform managerial tasks, including but not limited to:
(1) Setting goals and developing strategies to carry out the policy objectives set by the executive;
(2) Administering and enforcing all ordinances, orders, and resolutions of the executive and Town Council, to ensure that laws and policies are enforced equally throughout the town;
(3) Monitoring the performance of all operating departments;
(4) Coordinating inter-department communication and action;
(5) Assisting the executive in developing an annual budget with department managers and monitoring expenses;
(6) Evaluating town needs and advising the executive on recommended courses of action;
(7) Coordinating public service programs;
(8) Representing the town to other governmental entities and agencies;
(9) Representing the town to the public and managing public relations; and
(10) Engaging citizen involvement in planning and problem solving, serving as consensus building facilitator.
(G) Employment issues. The Deputy Mayor shall assist in approving hiring and other personnel decisions for town employees below the level of Department Manager in accordance with the town's salary ordinance and any other policies established by the executive. In addition, the Deputy Mayor shall advise the executive on personnel matters concerning Department Managers, including, without limitation, making recommendations to the Town Council on disciplinary and termination issues; provided, however, the Deputy Mayor shall not promote, discipline, hire, suspend, discharge, remove or transfer a Deputy Manager without the prior approval of the executive.
(H) Compensation and performance bond. The Town Council shall set the amount of compensation, including benefits, for the Deputy Mayor. The Deputy Mayor shall be required to execute a performance bond for the faithful performance of the Deputy Mayor's duties, as set forth in I.C. 5-4-1 and I.C. 36-4-9-7.

The position of Director of the Department of Finance and Records ("Director") shall be created and shall be subject to the following:
(A) The position of Director is a full-time exempt position and paid compensation and benefits according to the current annual Zionsville Salary Ordinance ("salary ordinance"); and
(B) The Director is an at-will employee subject to the provisions contained in this section and the provisions of the Town of Zionsville Reorganization 2.0 as passed by the Town Council in Resolution No. 2014-11 ("Reorganization 2.0"); and
(C) The position shall be subject to a job description created by the Director of Human Resources for the town and approved by the Town Council; and
(D) The position shall be required to meet the duties and obligations of the town as outlined in state statue, town ordinance, the Town Employee Handbook and other such policies for employment with the town; and
(E) The position is a department head and shall provide oversight and supervision of all employees of the Department; and
(F) The Director shall inform the Director of Human Resources of any and all concerns related to an employee that serves as a direct report of the Director. The Director of Human Resources shall consult with the Director prior to an employment action resulting to suspension or termination of an employee of the Department unless the action(s) of the Department employee are such that there is an immediate risk of death, injury or reckless endangerment of the Department employee, to other town employees or the public at large. Notwithstanding, the ultimate decision to suspend or terminate an employee (other than the Director, as a department head) shall be a decision of the Mayor upon recommendation of the Director of Human Resources; and
(G) Pursuant to Reorganization 2.0 section ZR2A3, the Mayor shall appoint the Director; and
(H) The Director will be subject to Reorganization 2.0 section Z42A24 which states that the Mayor must have the approval of the majority of the Town Council before the executive may discharge a department head; and
(I) Pursuant to Reorganization section ZR2A3, the Director shall be responsible for all statutory duties of the Clerk Treasurer of a town found in I.C. 36-5-6 et seq. Such duties may be delegated to other employees of the town to complete the day-to-day tasks to fulfill such statutory duties; and
(J) The Director shall work under the policies, budgets, and directors established by the Mayor and the Town Council; and
(K) The Director is the senior paid staff executive responsible for all operations of the Department; and
(L) The Director shall coordinate and consult with the Mayor, Deputy Mayor, other department heads and the Town Council President as needed and necessary to carry out the duties of the Director and the Department; and
(M) The Director shall be responsible for preparing any and all required financial statements and records required by the Town Council to fulfill the Town Council's duty as the legislative body of the town; and
(N) The Director shall timely provide to the Town Council, at the request of the Town Council President and any member of the Town Council, any and all financial statements and records of the town to full the Town Council's duty as the legislative body of the town; and
(O) The Director shall annually prepare a recommended budget for the Department and the town and provide such recommended budget to the Mayor and to the Town Council as part of the town's budget adoption process which shall be completed on a schedule set by the President of the Town Council; and
(P) The Director shall be responsible for recommending new positions to the Director of Human Resources, as needed and necessary to carry out the duties of the Department. The Director shall submit a list of such positions as needed and no less than annually for consideration by the Mayor and the Town Council.
(Q) Any and all new job descriptions, salary and benefits for any such position must be approved by the Town Council prior to advertising the position or interviewing candidates for a position (including both internal and external candidates). No employment offer shall be made for a new position of the Department unless the position has been approved and funded by the Town Council. This requirement does not apply to positions that have been previously approved in the town's current salary ordinance and funded in the Department budget that has been approved by the Town Council as part of the town's budget as amended from time-to-time.

(A) The position of Deputy Director of Finance and Records ("Deputy Director") is a full-time non-exempt position and paid compensation and benefits according to the annual town salary ordinance; and
(B) The Deputy Director is an at-will employee; and
(C) The position shall be subject to a job description created by the Director of Human Resources for the town and approved by the Town Council; and
(D) The position shall be required to meet the duties and obligations of the town as outlined in state statute, town ordinance, the Town Employee Handbook and other such policies for employment with the town; and
(E) The Deputy Director works under the direction and supervision of the Director; and
(F) The position works with minimum supervision and shall perform administrative functions in support of the Department.
