935.17 EXTRA STRENGTH SURCHARGE, COSTS EXCEEDING LIMITATIONS.

   Where flows and loads are discharged in excess of the limitations established in Section 931.05 (c) a surcharge over and above the charges established in Section 936.16 shall be levied on all flow and loadings which are in excess of the limitations set forth in Section 935.13.

   The surcharge shall be calculated annually in accordance with the volumes and amounts established in Section 935.15 to be effective January 1 of each year.

      ANNUAL SURCHARGE = (Bx) + (Sy) + (Oz)

      WHERE: B=   Hundreds of pounds of BOD discharged annually in excess of 210 mg/l.

          x=   The amounts established in Section 935.15 (j) (8) B. divided by value determined in Section 935.15 (a) (2).

          S=   Hundreds of pounds of SS discharged annually in excess of 240 mg/l.

          y=   The amounts established in Section 935.15 (j) (8) C. divided by value determined in Section 935.15 (a) (3).

          O=   Hundreds of pounds of other pollutant discharged annually in excess of normal strength limitations.

          z=   The amounts established in Section 935.15 (j) (8) D. divided by value determined in Section 935.15 (a) (4).
