547.29 DEFINITIONS FOR SECTION 547.28.
   For the purposes of Section 547.28 of this chapter:
   (a)   "Minority" means persons who are citizens of the United States, who are Black, Hispanic, Asian or Pacific Islander, American Indian or Alaskan Native.
   (b)   "Minority business Enterprise" means a business Enterprise that is both owned and controlled by minority group persons.
   (c)   "Female business Enterprise" means a business Enterprise that is both owned and controlled by females.
   (d)   "Owned and controlled" means by:
      (1)   An individual who is a minority person or a female;
   (2)   A partnership controlled by minority persons or females and in which at least fifty-one percent (51%) of the beneficial ownership interests and control are held by minority persons or females; or
   (3)   A corporation or other entity controlled by minority persons or women and in which at least fifty-one percent (51%) of the voting interests and fifty-one percent (51%) of the beneficial ownership interests are held by minority persons or females. The person with fifty-one percent (51%) ownership must also control management and daily business operations.
   (e)   "Joint venture" means a combination of contractors performing a specific job in which minority business enterprises participate and share a percentage of the net profit or net loss.
   (f)   "Department" means the department, board, agency or other instrumentality of the City responsible for awarding contracts subject to the provisions of Section 547.29 through 547.34.
   (g)   "Commission" means the Human Relations Commission of the City.
   (h)   "Contract" when used in this chapter shall mean any contractual arrangement between the City and any "for profit" corporation, including those for which various development incentives are granted by Council. (Ord. 86-142. Passed 5- 28-86.)
