A. Permit Required: No person shall operate, build, use or otherwise possess an animal establishment without first obtaining a permit as provided in section 90.55 of this chapter.
B. Regulations:
1. No animal establishment shall be maintained closer than three hundred feet (300') to any hotel, restaurant, boarding house, retail food store or building used for educational, religious or hospital purposes; except that a grooming shop, temporary animal boarding establishment may be maintained within three hundred feet (300'), but no closer than one hundred fifty feet (150') to any hotel, restaurant, boarding house, retail food store or building used for educational, religious or hospital purposes so long as the animals do not remain on the premises during the overnight period defined herein as being from eight o'clock (8:00) P.M. to six o'clock (6:00) A.M.
2. No animal establishment shall be maintained closer than forty feet (40') to any residence other than that occupied by the owner of the premises upon which the animal is owned, harbored or kept.
3. Every animal establishment wherein an animal is owned, harbored or kept shall be maintained in a clean and sanitary condition, devoid of rodents and vermin, and free of objectionable odors.
4. Every animal establishment shall be provided with a watertight and flytight receptacle for manure, of such size as to hold all accumulations of manure. Such receptacle shall be emptied sufficiently often and in such a manner as to prevent it from becoming a nuisance and shall be kept covered at all times, except while opened during the deposit or removal of manure or refuse. No manure shall be allowed to accumulate on such premises except in such receptacle. Manure shall be hauled outside the city in a manner which does not jeopardize the public health, or else shall be spread evenly upon the ground and turned under immediately.
C. Pasturing, Staking Or Confining An Animal: No person shall pasture, stake or confine any animal on any property within the city without the written consent of the owner of such property.
D. Establishments To Comply With Building Code: Any animal establishment erected or used within the city must comply with the building code for buildings, sheds or structures as such is in effect within the city.
E. Animal Control Officer To Inspect: The animal control officer, upon complaint of any person or upon his own initiative, may inspect any stable, kennel, coop, building or other establishment wherein animals are being owned, harbored or kept. He may issue any reasonable order necessary to cause such animal to be owned, harbored and kept as provided in this chapter and in such a manner as to not constitute a nuisance.
F. Turning Animals At Large Prohibited: No person shall open any enclosure in which any animal is confined so as to turn such animal at large, or to release any animal from a leash or chain so as to turn such animal at large, or to turn an animal at large in any other manner. (2001 Code § 90.22)
