10-1-2: PURPOSE; ACCOMPLISHING PURPOSES:
The purpose of this title is to regulate the use of land and establish standards that implement the comprehensive development plan and other adopted plans, policies and codes for the village, as amended from time to time.
   A.   Furthermore, this title is adopted for the following purposes:
      1.   To promote the public health, safety, comfort, morals, convenience, and general welfare.
      2.   To secure adequate light, pure air, and safety from fire and other dangers.
      3.   To conserve the taxable value of land and buildings throughout the village.
      4.   To avoid or lessen congestion in the public streets.
      5.   To lessen or avoid hazards to persons and damage to property resulting from the accumulation or runoff of storm or flood waters.
   B.   To these ends, this title is designed to set up and accomplish certain standards and objectives as follows:
      1.   To divide the entire village into districts and restricting and regulating therein the location, construction, reconstruction, alteration and use of buildings, structures and land, whether for residence, business, industrial or other specified uses.
      2.   To prevent the overcrowding of land through regulating and limiting the height and bulk of buildings hereafter to be erected as related to land area.
      3.   To establish, regulate and limit the building or setback lines on or along streets, alleys or property lines.
      4.   To regulate and limit the intensity of the use of lot areas, and regulating and determining the area of open spaces within and surrounding such buildings.
      5.   To establish standards to which buildings or structures therein shall conform.
      6.   To promote buildings, structures or uses that are compatible with the created herein districts.
      7.   To encourage additions to and alterations or remodeling of existing buildings or structures to comply with the restrictions and limitations imposed hereunder.
      8.   To provide for the gradual elimination of those uses, buildings and structures which are incompatible with the character of the districts in which they are made or located.
      9.   To define and limit the powers and duties of the administrative officers and bodies as provided herein.
      10.   To prescribe the penalties for the violation of the provisions of this title or of any amendment hereto.
      11.   Nothing contained in this title shall be deemed to be a consent, license or permit to use any property or to locate, construct or maintain any building, structure or facility, or to carry on any trade, industry, occupation or activity. (Ord. 2010-04-07, 4-1-2010)
