§ 110.32 RESPONSIBILITY FOR CONTRACTED WORK.
   (A)   A contractor shall be responsible for all work included in his or her contract, whether or not such work is done by him or her directly or by a subcontractor.
   (B)   A contractor shall be responsible for all funds or property received by him or her for prosecution, for completion of a specific contract or for a specific purpose.

§ 110.33 SAFETY STANDARDS GENERALLY.
   All state laws, provisions of the town’s ordinances addressing measures for the safety of workers and the public shall be observed by contractors within the town, in addition to any requirements contained within this subchapter.

§ 110.34 SUSPENSION OR REVOCATION OF LICENSE.
   (A)   In addition to any other provision of any other ordinances of the town, the Town Clerk may suspend or revoke a license issued under this subchapter if:
      (1)   The licensee fails to meet the qualifications required of an applicant;
      (2)   The licensee violates any provision of this subchapter or any other ordinance of the town governing the activities permitted by the license;
      (3)   The licensee violates any of the building and safety codes adopted by the town or fails to obtain a building or other type of permit required to perform the work;
      (4)   The licensee obtained the license by fraud or misrepresentation; or
      (5)   The licensee’s acts or performance under the license is unworkmanlike, careless or reckless.
   (B)   Except for an emergency suspension as authorized by division (C) below, no suspension or revocation shall be imposed until a hearing has been held before the Town Manager. The licensee shall be given written notice of such hearing at least ten days in advance, and shall be advised of the specific grounds for the proposed suspension or revocation. Following the hearing, if the Town Manager finds one or more grounds support suspension or revocation of the license, the Town Manager shall determine whether to revoke the license for the remainder of its term or suspend it for any shorter period, depending on the severity of the disqualification or violation by the licensee; its effect on public health, safety and welfare; and the time during which the disqualification or violation can be remedied, if at all. The Town Manager may also include reasonable orders or conditions with which the licensee shall comply to protect any work in progress and the public health and safety.
   (C)   (1)   The Town Manager may summarily suspend a license for up to 14 days if the Town Manager determines that an emergency suspension is in the interest of public health, safety and welfare.
      (2)   The Town Manager may include in the summary suspension reasonable orders or conditions with which the licensee shall comply to protect any work in progress and the public health and safety.
      (3)   Any breach of such conditions or orders is an independent ground for suspension or revocation of the license.
   (D)   No person whose license is suspended or revoked pursuant to this subchapter may receive a refund of any part of the license fee paid for the license.
   (E)   No person who has had a license suspended or revoked pursuant to this subchapter is entitled to obtain the same or any similar license during the period of suspension or revocation, either in the person’s own name or as a principal in another business that applies for a license.
   (F)   Nothing in this section shall be deemed to prohibit the Town Manager or any other authority from imposing other penalties authorized by any other ordinances of the town, including filing a complaint in the Municipal Court for a violation of this subchapter or any other ordinance of the town.

§ 110.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   Any person convicted of violating any of the provisions of §§ 110.01 through 110.14 shall be punished by a fine of not more than $2,650, as shall be adjusted for inflation from time to time pursuant to C.R.S. § 13-10-113. Each act or omission in violation of one or more of the provisions of §§ 110.01 through 110.14 shall be deemed a separate violation for each and every day that such act(s) or omission(s) occur.
   (C)   (1)   It shall be unlawful for any contractor to fail to obtain a permit of inspection services when required.
      (2)   It shall be unlawful for any contractor licensed under §§ 110.25 through 110.34 to, without good cause, abandon any contract or undertaking, or to make material departure from the town-approved plans and specifications for any contract or undertaking.
      (3)   It shall be unlawful for any contractor licensed under the provisions of §§ 110.25 through 110.34 to violate any provision of §§ 110.25 through 110.34; or to refuse to obey any order issued, or neglect to pay any fee assessed, under authority of §§ 110.25 through 110.34.
      (4)   It shall be unlawful for any person to erect, construct, enlarge, alter, repair, move, improve, convert, demolish, equip, use, occupy or maintain any building or structure in the town, or to cause such work to be done, contrary to or in violation of any provision of §§ 110.25 through 110.34.
      (5)   It shall be unlawful for a contractor to be careless or negligent in obtaining minimum safety measures, including appliances, apparatus and equipment, to protect workers and the public.
      (6)   Any person convicted of violating any of the provisions of §§ 110.25 through 110.34 shall be punished by a fine of not more than $2,650, as shall be adjusted for inflation from time to time pursuant to C.R.S. § 13-10-113 or by imprisonment for not more than one year or by both such fine and imprisonment. Each act or omission in violation of one or more of the provisions of §§ 110.25 through 110.34 shall be deemed a separate violation for each and every day that such act(s) or omission(s) occur
