1. Compliance Required. Any person, firm, sole proprietorship, partnership, corporation, State agency or political subdivision (applicant) required by law or administrative rule to apply to the IDNR for a State NPDES General Permit No. 2 is subject to the terms of this chapter.
2. Requirements of Applicant. Prior to the issuance of any permits by the City for construction activities on the site, an applicant shall:
A. Submit to the City a copy of the site plan prepared by the applicant to meet the requirements of the State NPDES General Permit No. 2. The site plan shall show best management practices (BMP) control measures and a stormwater pollution prevention plan (SWPPP) applicable to the site.
B. Submit a copy of the applicant’s authorizations issued pursuant to applicant’s State NPDES General Permit No. 2, including a copy of said permit issued by the IDNR for this site.
3. SWPPP Requirements. Every SWPPP submitted to the City shall:
A. Comply with all existing requirements for SWPPPs promulgated by the IDNR in connection with issuance of a State NPDES General Permit No. 2; and
B. If the applicant is required by law to file a joint application form protecting Iowa waters, IDNR and U.S. Army Corps of Engineers, comply with all mandatory minimum requirements pertaining to such applicants; and
C. Comply with all other applicable State or federal permit requirements in existence at the time of application, including, but not limited to, waste at construction sites that may cause adverse impact to water quality such as building materials, concrete truck washout, chemicals, solid waste and sanitary waste.
4. Off-Site Soils Tracking. All construction sites shall be furnished with a stabilized construction site entrance to handle the type and frequency of the traffic entering and exiting the site or make use of some other method designed to prevent off-site tracking. Any soils tracked off site shall be cleaned up by the applicant at the end of each day or before sediments enter the public storm sewer or stormwaters of the State. Any soils entering public storm sewer or stormwaters of the State will be considered a violation of this chapter.
