99.09   UNIVERSITY TRUNK SEWER DISTRICT NO. 2.
1.   District Established. There is hereby established Connection Fee District
No. 2 for connection of the property described herein to the University Avenue trunk sewer and providing for fees therefor.
2.   Connection Fees. A connection fee is hereby established and imposed upon the owners of property within Connection Fee District No. 2 of the University Avenue trunk sewer, who shall hereafter make application to connect their property to the University Avenue trunk sewer or sewer lines connected thereto. The connection fee shall be computed as follows:
   A.   Single-family residential land use connection fee: a base fee in 2011 of $6,130.99 per acre of gross land within the development, streets, and common spaces inclusive.
   B.   Land use other than single-family residential: a connection fee base as the higher of the following two methods of computation:
      (1)   $6,130.99 per acre of gross land within the development, streets, and common spaces inclusive; or
      (2)   $6,130.99 per 1,000 gallons per day of average water usage. The initial conditional fee will be based on projected water use. The actual fee will be determined by the highest monthly water use (exclusive of irrigation water separately metered) during the
12-month period after the site is fully developed and operational at the base fee of $6,130.99 per 1,000 gallons per day.
3.   The aforementioned connection fees shall be escalated at the rate of five percent per year, compounded annually commencing on January 1, 2012. Commencing January 1, 2013, no further interest increases shall occur.
4.   Eligibility for Connection. The following provisions for connection of property within the connection fee district, in existence or under construction upon the effective date hereof, and the following procedures for future division of property within the benefited district shall be applicable: All property located within the corporate limits of the City and within Connection Fee District No. 2 of the University Avenue trunk sewer shall be eligible for connection to the University Avenue trunk sewer upon approval of an application for connection by the owner thereof, as hereafter provided, and payment of the connection fee for such property; provided, capacity in said sewer is then available; and provided, such property has been appropriately subdivided for development; and further provided, all sanitary sewer improvements necessary to serve said property have been constructed and approved by the City.
5.   Land Description. The following described real estate is hereby designated as Connection Fee District No. 2 of the University Avenue trunk sewer:
CONNECTION FEE DISTRICT B
An area in Sections 4 and 5, Township 78 North, Range 26 West of the 5th Principal Meridian, Dallas County, Iowa, more particularly described as follows: Commencing at the northwest corner of Section 4, T78N, R26W; thence easterly along the north line of said Section 4 to the south right-of-way line of the Chicago and Northwestern Railroad; thence southeasterly along said south right-of-way line to the intersection of the east lot line of Government Lot 2 of Section 4, T78N, R26W; thence southerly along the east lot line of said Government Lot 2 to a point that is 650.0 feet south of the north line of Section 4, T78N, R26W; thence westerly to the west lot line of said Government Lot 2, said point also lying 650.0 feet south of the north line of Section 4, T78N, R26W; thence north 300.0 feet; thence westerly to a point on the west line of Government Lot 1 of Section 5, T78N, R26W, said point also lying 350.0 feet south of the north line of said Section 5; thence northerly 350.0 feet; thence easterly to the point of beginning, except for public rights-of-way, streets, and railroads containing 50.04 acres, more or less, except Parkview Crossing, an official plan, now included in and forming a part of the City of Waukee, Iowa.
CONNECTION FEE DISTRICT C
An area in Section 3, Township 78 North, Range 26 West of the 5th Principal Meridian, Dallas County, Iowa, more particularly described as follows: Commencing at the northwest corner of Government Lot 5 of Section 3, T78N, R26W; thence northerly to the south right-of-way line of the Chicago and Northwestern Railroad; thence southeasterly along said south right-of-way line to the intersection of the west right-of-way line of Waco Place; thence southerly along the said west right-of-way line to the north line of Government Lot 5 of Section 3, T78N, R26W; thence easterly to the northeast corner of said Government Lot 5; thence southerly along the east lot line of said Government Lot 5 200.0 feet; thence westerly parallel to the north line of said Government Lot 5 to a point on the north-south centerline of said Government Lot 5; thence southerly to the center of said Government Lot 5; thence westerly along the east-west centerline of said Government Lot 5 to the west line of said Government Lot 5; thence northerly to the point of beginning, except for public rights-of-way, streets, and railroads containing 34.42 acres, more or less.
CONNECTION FEE DISTRICT D
An area in Section 35, Township 79 North, Range 26 West of the 5th Principal Meridian, Dallas County, Iowa, more particularly described as follows: Commencing at the northwest corner of the Northeast Quarter of the Southwest Quarter of Section 35, T79N, R26W; thence easterly to the northeast corner of the Northwest Quarter of the Southeast Quarter of said Section 35; thence southerly to the southeast corner of the Northwest Quarter of the Southeast Quarter of said Section 35; thence westerly to the southwest corner of the Northeast Quarter of the Southwest Quarter of said Section 35; thence northerly to the point of beginning, containing 80.00 acres, more or less.
CONNECTION FEE DISTRICT E
An area in Section 35, Township 79 North, Range 26 West of the 5th Principal Meridian, Dallas County, Iowa, more particularly described as follows: Commencing at the northeast corner of the Northeast Quarter of the Southeast Quarter of Section 35, T79N, R26W; thence southerly to a point that is 28.0 feet south of the northeast corner of the Southeast Quarter of the Southeast Quarter of Section 35, T79N, R26W; thence westerly 278.0 feet; thence northerly 357.15 feet; thence easterly 45.0 feet to the southwest corner of Lot 4 of Seven Pines Plat 1 of the Northeast Quarter of the Southeast Quarter of Section 35, T79N, R26W; thence northerly 488.13 feet to the northwest corner of Lot 1 of Seven Pines Plat 1 of the Northeast Quarter of the Southeast Quarter of Section 35, T79N, R26W; thence westerly to a point that is 500.0 feet south and 726.0 feet west of the northeast corner of the Northeast Quarter of the Southeast Quarter of Section 35, T79N, R26W; thence northerly 500.0 feet; thence easterly to the point of beginning, except for public rights-of-way, streets, and railroads containing 12.73 acres, more or less.
