945.04 WRITTEN NOTICE.
     (a)   Notwithstanding the penalty contained in Section 945.99, and in addition thereto, when the Building Commissioner ascertains that either noxious weeds, as described in Section 945.02 are growing on lands within the City, he/she shall cause written notice to be served upon the owner, lessee, agent or tenant having charge of such lands that either noxious weeds, or weeds, grass and plants are growing on such lands in violation of Section 945.02 or Section 945.03, they must be destroyed by any of the methods set forth in Section 945.02, and as to weeds, grass and plants they must be cut to a height no more than six inches, and that such destruction must be commenced within three days after the service of the notice and maintained throughout the remainder of the grass cutting season. Only one notice to the owner, lessee, agent or tenant as provided in this section shall be necessary in any one grass cutting season. The notice shall indicate that noxious weeds or weeds, grass and plants not destroyed or cut by a certain date, determined by the Building Commissioner, taking into account the weather conditions and projected growing season of each year will be destroyed or cut by the City and the owner, lessee, agent or tenant of the property charged with the cost, and that only one written notice will be given so that if the property owner is in violation of this chapter at any future date during the grass cutting season, the nuisance will be abated pursuant to this chapter without further notice. If the owner or other person having charge of the lands is a nonresident whose address is known, the notice shall be sent to his address by registered mail; if the address of the owner is unknown, it shall be sufficient to publish the notice once in a newspaper of general circulation in the City.
   
   (b)   If public notice is placed in a newspaper of general circulation in the City to notify the owner or other person having charge of the land, the cost of placing that notice must be paid by the owner or other person having charge of the land.
