No tree, ornamental plant or shrub shall be planted on any public street, tree lawn or public ground within the City, except with the written permission of the Building Commissioner, who shall grant such permission only if he finds that the proposed planting will not interfere with the appropriate public use of such street or ground and is consistent with any plan of planting already in effect thereon. Such permission shall specify the manner in which such planting shall be done in order to insure such consistency and lack of interference. Permission shall not be granted to any person to plant any tree on a public street or tree lawn closer than forty feet to the next adjacent tree on the street or tree lawn. No tree shall be planted closer than ten feet to any fire hydrant or closer than two feet to any curb or sidewalk. No permission shall be given to plant on any public street, tree lawn or public place any of the following types of trees: poplar, bush elder, bass wood, willow, mulberry or soft maple.

No person shall remove, destroy, cut down, prune, spray or injure any tree, ornamental plant or shrub in any public street, tree lawn or public ground within the City, except with and in conformity with the written permission of the Building Commissioner, which permission shall be given when the Commissioner finds that the proposed action is necessary to preserve the appropriate use of such street or public ground.

No person shall permit any substance harmful to tree life to come in contact with the soil surrounding the roots of any such tree, ornamental plant or shrub in such manner as to kill or injure the same, or fail to provide a good and sufficient protection for any such tree, ornamental plant or shrub against any injury arising from any building operation.
