943.07 REMOVAL OF TREES BY CITY; CHARGE.
   (a)   Upon application executed by a property owner within the City and presented to the Clerk of Council, requesting the removal of a tree or trees located within the City, the City, subject to the approval of the Director of Public Service concerning the size and location of such trees and in accordance with a service charge to be determined by the Director in an amount of not less than the following:
      (1)   One hundred twenty-five dollars ($125.00) for a small tree (trunk diameter two (2) inches or less).
      (2)   Two hundred fifty dollars ($250.00) for a medium tree (trunk diameter two (2) inches to six (6) inches in diameter).
      (3)   Five hundred dollars ($500.00) for a large tree (trunk diameter greater than six (6) inches in diameter).
   The City shall make arrangements to provide equipment and will remove such trees within the corporate limits.
   (b)   Whenever a tree is located upon private property and such tree or a part thereof is found to be in a dead or dangerous condition and is so located that if such tree fell, or such part thereof broke off and fell, it could endanger life or property upon a street or upon other public property, the Service Director shall give written notice by personal service or by regular and/or registered mail to the owner of the property upon which such tree is located to remove such tree or part thereof within ten (10) days of the date of service or mailing of such notice. Failure of the owner of such premises to remove such tree or part thereof within ten (10) days shall be deemed a violation of this section.
   (c)   Whenever a tree is located upon private property and such tree or a part thereof is found to be in a dead or dangerous condition and is so located that if such tree fell, or such part thereof broke off and fell, it could endanger life or property upon the premises where such tree is located, or upon other private property, the Service Director shall give written notice by personal service or by certified or registered mail to the owner of the property upon which such tree is located to remove such tree or part thereof within thirty days of the date of service or mailing of such notice. Failure of the owner of such premises to remove such tree or part thereof within ten (10) days shall be deemed a violation of this section.
   (d)   Subject to the approval of the Director of Public Service concerning the size and location of such trees and in accordance with a service charge to be determined by the Director in an amount of not less than the following:
      (1)   Two hundred fifty dollars ($250.00) for a small tree (trunk diameter two (2) inches or less).
      (2)   Five hundred dollars ($500.00) for a medium tree (trunk diameter two (2) inches to six (6) inches in diameter).
      (3)   One thousand dollars ($1,000) for a large tree (trunk diameter greater than six (6) inches in diameter).
   The City shall make arrangements to provide equipment and will remove such trees within the corporate limits. (Ord. 2012-052. Passed 4-17-12.)
