As used in this chapter, unless otherwise provided:
(a) “Exhibitor” means any person owning and exhibiting or contracting or permitting any mechanical game device, as herein defined, to be installed, used and exhibited in his own place of business irrespective of the ownership of such devices.
(b) “Mechanical game device” or “electrically operated game device” means a machine which, upon the insertion of a coin or slug, operates, or may be operated, for use as a game, contest or amusement of any description, or which may be used for any such game, contest or amusement, and which contains no automatic pay-off device for the return of slugs, money, coins, checks, tokens, merchandise or anything of value, or which contains no automatic device by the operation of which the player may win at uncertain intervals a free game, a free play or any other additional amusement. This definition shall not include any mechanical or electrically operated game device which is a gambling device per se. This definition is not intended to and does not include merchandise vending machines.
(c) “Owner” means any person having title to any such mechanical game device as herein defined. (Ord. 1957-33. Passed 3-19-57.)
