§ 110.03  FILING OF APPLICATION.
   (A)   Any person desiring to engage in the activities set out in § 110.02, and any individual desiring to engage in the activities of a transient merchant as defined in § 110.01, shall first file a written application, signed and sworn to by the applicant, together with $5 to defray the cost of the processing of that application and the administration of this chapter, with the Clerk- Treasurer, at least two weeks prior to the time the applicant requests that the registration become effective, which application form shall contain the following information:
      (1)   The applicant's name, home address, and local address, if any;
      (2)   The name and address or principal office of entity for whom the applicant is authorized to conduct such activity; or a statement that the applicant is engaged in such activity solely on his own behalf;
      (3)   A brief description of the type of literary material, or merchandise, or services to be sold;
      (4)   A statement as to whether the applicant has been convicted of any felony or misdemeanor involving moral turpitude, and if so, the nature of the offense and punishment assessed therefor; and
      (5)   A sample copy of each order or receipt form to be used if the applicant wishes to solicit orders to be filled later.
   (B)   If, after the filing of the application, whether before or after the issuance of a registration certificate, the information in the application becomes inaccurate and the applicant or holder of a registration certificate intends to or does continue activity thereunder, detailed written notice of such change and the correct information shall be furnished to the Clerk-Treasurer within one business day of the information becoming inaccurate.
   (C)   Upon the applicant personally appearing at the office of the Clerk-Treasurer at least two weeks after such application has been filed, the Town Clerk-Treasurer shall issue a registration certificate which shall be dated, signed, and otherwise in a form to be determined by the Clerk-Treasurer; provided, however, that the Clerk-Treasurer shall not issue any certificate valid for a period of more than 90 days, and the Clerk-Treasurer shall not be required to issue a certificate to any person who shall have been convicted of any felony or misdemeanor within three years of the date of the filings of the application, or to any person who has violated § 110.06 or 110.07, or whose registration certificate has heretofore been revoked.
