A. The use of tobacco and vapor products is a public nuisance, is dangerous to the health of both adults and children, and sets an unhealthy example for the City of Vinita's youth and children. Therefore, the use of tobacco and vapor products and use of products containing tobacco in any form including smokeless tobacco, and all vapor products is hereby prohibited, and declared an offense, on all Municipal property.
B. For the purposes of this section, "Municipal property" shall be defined as any building, structure, vehicle, or parcel of open land, including all City parks, owned or leased by the City of Vinita.
C. The City of Vinita shall cause appropriate signage to be installed in prominent locations on all Municipal property with the ordinance's number and the words "TOBACCO AND VAPOR PRODUCTS PROHIBITED" written thereon.
D. Any person, firm, or corporation who shall violate the provisions of this section shall be guilty of a misdemeanor and upon conviction thereof shall be punishable by imposition of a fine of ten dollars ($10.00) excluding cost, fees, and assessments as provided in subsection 1-9-12A of this Code. Each day upon which any such violation continues shall constitute a separate misdemeanor. (Ord. 3708, 8-6-2019)
