6-3-1: LICENSING OF DOGS AND CATS:
   A.   License Required: It shall be unlawful for any resident to own, harbor, keep or possess a dog or cat without first procuring a license as provided by this chapter; provided however, that the provisions of this chapter shall not apply to any person visiting in the town for a period of not exceeding thirty (30) days and owning or possessing a dog or cat currently licensed and bearing a license issued by another municipality or another licensing authority. Owners of service dogs shall be required to obtain a license, but shall be exempt for the payment of fees.
   B.   Application For License: The owner or person having charge of any dog or cat shall make application to the town treasurer and provide such information as may be required, which shall include the type of dog and/or cat, the sex, the coloring and the name of the dog or cat. If the dog or cat is a spayed female, a statement of a licensed veterinarian verifying that fact must accompany the application.
   C.   Fee For License: Application for dog or cat license must be accompanied by fees as set by council. A regular license fee shall be charged for the first two (2) dogs and first two (2) cats. An additional surcharge for each dog or cat after the first two (2) shall be paid at the time of licensing and annually upon renewal of license.
   D.   Issuance Of License; Term: All dog and/or cat licenses shall be issued for the calendar year January 1 through December 31 and each license shall expire on the last day of such calendar year. Upon receipt of an application and payment of the required fees, the town treasurer shall issue a receipt designating the owner's name, the number of the license to be issued and the amount paid. At the same time, the town treasurer shall issue a metal tag bearing the number corresponding to the number on the receipt and such tag shall be known as the license.
   E.   Collar; Tag:
      1.   Required: Every dog and/or cat shall at all times wear a substantial and durable collar or harness to which the required license shall be securely attached.
      2.   In the event a dog or cat is trapped in the process of removing feral cats; the owner will be notified.
      3.   Lost Tag; Fee: Upon satisfactory proof that a license tag has been lost, a new tag of a different number may be issued upon the payment as set by council and the transaction shall be noted upon the town office file for the number originally issued.
   F.   All trapped dogs or cats will be held for twenty-four (24) hours to provide time to claim the dog and/or cat. After twenty-four (24) hours euthanasia will take place. (Ord. 170, 10-14-2009; amd. Ord. 179, 11-14-2013, eff. 12-14-2013; Ord. 186, 2-8-2021, eff. 3-8-2021)
6-3-2: RUNNING AT LARGE; ANIMALS:
   A.   Prohibited: It shall be unlawful for any person, to permit or allow any animal belonging to him or under his control, to run at large.
   B.   Dogs:
      1.   Prohibited: It shall be unlawful for any owner to allow or permit any dog, whether licensed or not, to be or remain upon the streets or alleys of the town or in any public place in the town, unless:
         a.   Such dog be in the charge of a person or controlled by a leash; or unless
         b.   Such dog is confined in a motor vehicle.
      2.   Fine: A fine will be levied against the owner of said dog or dogs in the amount as set by council. Any person not paying these fines will be held in contempt of court. (Ord. 170, 10-14-2009)
6-3-3: RABIES CONTROL:
   A.   Vaccination Required: All licensed or unlicensed dogs within the town must be vaccinated annually preventing a possible outbreak of rabies in the town.
   B.   Quarantine; Disposition: The town or designee shall have authority to order the owner of any dog showing symptoms of rabies or of any dog which has bitten any person so as to cause an abrasion of the skin, to subject such dog to the pound for quarantine for a period of not to exceed fifteen (15) days, and if such dog shall be determined free of rabies the same shall be returned to the owner.
   C.   Afflicted; Destruction: Any dog afflicted with rabies shall be disposed of immediately, either by the owner or by the town or designee. (Ord. 170, 10-14-2009)
6-3-4: IMPOUNDING:
The town or designee may impound any and all animals found running at large in the streets, alleys or other public places or other premises, whether such animal so running at large is owned or harbored by a person residing within the corporate limits or elsewhere. The town or designee may impound any and all dogs without collars bearing licenses as required herein; provided, that when a dog wearing a collar bearing a license tag of the preceding year is taken up, the town or designee shall notify the owner or representative of the owner, if such owner or representative can be found. The owner or representative of the owner of any dog which may be taken up and impounded under the provisions of this chapter, may recover possession of such dog upon payment to the town or designee of the license fee and upon payment of fees and costs of impound. If the owner or representative of the owner of any dog taken up and impounded under the provisions of this chapter shall fail to pay the license fee and the costs and fees related to this chapter as set by council within five (5) days after such notice has been given, the town or designee may dispose of such dog by:
   A.   Delivering the same to any person who will pay the license and the costs and fees herein provided.
   B.   Destroying such dog in a humane manner. (Ord. 170, 10-14-2009)
