ADOPTING ORDINANCE NO. 3790
AN ORDINANCE TO APPROVE THE CODIFIED ORDINANCES OF THE CITY OF URBANA, OHIO, 1989, AND DECLARING AN EMERGENCY.
   WHEREAS, a determination has been made that the City's ordinances of a permanent and general nature should be recodified, and
 
   WHEREAS, Council has heretofore entered into a contract with the Walter H. Drane Company to prepare and publish such recodification, and
 
   WHEREAS, the Traffic and General Offenses Code portions of the recodification have been approved by Ordinance 3784; and
 
   WHEREAS, the recodification of such other ordinances, together with the new matter to be adopted, the matters to be amended and those to be repealed are before the Council; and
 
   WHEREAS, notice of the proposed recodification of the City's ordinances has been published one time in a newspaper of general circulation in the City at least seven days prior to the adoption of this Ordinance as required by Section 2.19 of the City Charter;
 
   NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF URBANA, OHIO:
 
SECTION ONE.
 
   That the revised, recodified, rearranged and consolidated ordinances of the City of Urbana, consisting of the following Parts, Titles and Chapters (the complete texts of which are incorporated herein by reference) are hereby approved, adopted and enacted as the Codified Ordinances of the City of Urbana, Ohio, 1989:

SECTION TWO.
   That the provisions of this Ordinance, including all provisions of the Codified Ordinances, shall be in full force and effect as provided in Section Six of this Ordinance. The enactment of the Codified Ordinances shall not be construed to affect a right or liability accrued or incurred under any legislative provisions prior to the effective date of such enactment, or an action or proceeding for the enforcement of such right or liability. Such enactment shall not be construed to relieve any person from punishment for an act committed in violation of any such legislative provision, nor to affect a prosecution therefor. For such purposes, any such legislative provision shall continue in full force not withstanding its repeal for the purpose of revision and recodification.
SECTION THREE.
   That each section of the Codified Ordinances without an ordinance or resolution at the end thereof indicates that the section contains new material which is hereby enacted by this adopting ordinance.
SECTION FOUR.
   That through authentication and approval of this Ordinance the Mayor and Clerk of Council shall certify that the permanent and general ordinances of the City as codified therein are correctly set forth and constitute the Codified Ordinances of the City of Urbana, Ohio, 1989.
SECTION FIVE.
   That the existing Title I: General Provisions, Chapters 10 and 11; Title III: Administration, Chapters 30 thru 37; Title V: Public Utilities, Chapters 50 thru 56; Title VII: Traffic Code, Chapters 70 thru 77; Title IX: General Provisions, Chapters 90 thru 99; Title XI: Business Regulations, Chapters 110 thru 118; Title XIII, Chapters 130 thru 139; and Title XV, Chapters 150 thru 155 are repealed.
   The repeal of the foregoing shall not affect:
   (1)   The grant or creation of a franchise, license, right, easement or privilege.
   (2)   The purchase, sale, lease or transfer of property.
   (3)   The appropriation or expenditure of money or promise or guarantee of payment.
   (4)   The assumption of any contract or obligation.
   (5)   The issuance and delivery of any bonds, obligations or other instruments of indebtedness.
   (6)   The levy or imposition of taxes, assessments or charges.
   (7)   The establishment, naming, vacating or grade level of any street or public way.
   (8)   The dedication of property or plat approval.
   (9)   The annexation or detachment of territory.
SECTION SIX.
   And that this Ordinance is hereby declared to be an emergency in order that the complete updated Code of Ordinances shall be effective simultaneously and be in compliance with State law.
