1 ARTICLE I. DISPOSITION OF ABANDONED PROPERTY

Sec. 4-1.   Abandoned or unclaimed personal property custody of Police Department.
   All unclaimed or abandoned property of every kind, other than contraband, confiscated alcoholic beverages, abandoned vehicles (refer to Tyler Police Department General Orders for definition and procedure for removal), junked vehicles (refer to sections 18-30 through 18-35 for definition and procedure for removal), and abandoned boats and barges (refer to section 19-169 for definitions and procedure for removal), shall be disposed of pursuant to this ordinance and preserved, protected, stored, and retained under the direction of the Police Chief unless that property is otherwise held as evidence to be used in a pending case or ordered to be destroyed, or to be returned to the person entitled to possession by a Magistrate. If the abandoned or unclaimed property is money, the Purchasing Agent, after giving notice under section 4-3, shall deposit the money in the City treasury without conducting the sale required by Section 4. Sec. 4-2.   Property-Record.
   The time and occasion of property coming into the possession of the Police Department shall be kept in a record book reflecting the manner of acquisition, a description of the property, and the preservation, storage and ultimate disposition of the property or proceeds thereof.
