§ 95.99  PENALTY.
   (A)   Whoever makes or causes any opening to be made without having obtained a permit, as required under §§ 95.01 (A) or 95.02, shall be fined not less than $25 nor more than $50 for each offense, and each opening made in violation of these sections shall be considered a separate offense.
   (B)   Whoever violates any provisions of § 95.20, or refuses or fails to comply therewith, shall be fined not more than $5 for each offense.
   (C)   Whoever violates any provision of §§ 95.04, 95.05, 95.17, 95.18, 95.19 or 95.30  shall be fined not more than $50 for each offense.
   (D)   Whoever violates any provision of §§ 95.01 (B) or 95.03 shall be fined not more than $l00 for each offense.  In addition, the restoration or replacement of the excavation or surface thereof shall be undertaken by the municipality, and, for the cost thereof (in the schedule of charges), the municipality shall have a civil cause of action against the person, firm, partnership, company, corporation, or agent thereof for the full amount of the cost, together with interest at the rate of 6% per annum, plus court costs and attorney fees.
