4-3-8: INDEMNIFICATION OF CITY:
The licensee shall at all times protect and hold harmless the City from all claims, actions, suits, liability, loss, expense or damages of every kind and description, including investigation costs, court costs and attorney fees, which may accrue to or be suffered or claimed by any person arising out of the negligence of the licensee in the ownership, construction, repair, replacement, maintenance and operation of the cable television system. The City shall give the licensee prompt written notice of any such claims filed against it. (1977 Code § 5.28.080)
4-3-9: CONDITIONS ON STREET OCCUPANCY:
   A.   Location Of Transmission Lines, Structures: All transmission and distribution structures, lines and equipment erected by the licensee within the City shall be so located as to cause minimum interference with the proper use of the streets, alleys and other public ways and places, and to cause minimum interference with the rights and reasonable convenience of property owners who adjoin or abut any of the said streets, alleys or other public ways and places.    B.   Restoration Of Street, Public Way: In case of disturbance in the street, sidewalk, alley, public way, grass or paved areas or any other public or private property, the licensee shall, at its own expense and in the manner approved by the Street Superintendent replace and restore said street, sidewalk, alley, public way, grass or paved area or any other public or private property in as good a condition as before the work involving such disturbance was done.    C.   Street Grade Alteration By City; Duties Of Licensee: If at any time the City shall lawfully elect to alter or change the grade of any street, sidewalk, alley or other public way, the licensee shall, upon reasonable notice in writing from the City, remove, re-lay and relocate its poles, wires, cables, underground conduits, manholes and other fixtures at its own expense.
   D.   Placement Of Fixtures: Any fixture placed in any public way by the licensee shall be placed in such a manner as not to interfere with the usual travel on such public way. (1977 Code § 5.28.060)
4-3-10: SAFETY REQUIREMENTS:
   A.   Prevention Of Accidents: The licensee shall at all times employ ordinary care and shall install and maintain in use commonly accepted methods and devices for preventing failures and accidents which are likely to cause damage, injuries or nuisance to the public.
   B.   Compliance With City Regulations: The licensee shall install and maintain its wires, cables and fixtures and other equipment in accordance with requirements of the ordinances, code and regulations of the City, and in such a manner that they will not interfere with any installation of the City or public utilities serving the City.
   C.   Maintenance Of Equipment: All structures and lines, equipment and connections in, over, under and on the streets, sidewalks, alleys and public ways or places of the City, wherever situated or located, shall at all times be kept and maintained in a safe, suitable, substantial condition and in good order and repair. 4-3-11: PERSON DESIGNATED AS AGENT:
The licensee shall file with the City Clerk, the name, address and telephone number of one or more persons who shall be its agent or agents to receive communications from the City or subscribers of the licensee. (1977 Code § 5.28.090)
4-3-12: OPERATIONAL STANDARDS:
The licensee shall operate and maintain its cable television system in full compliance with whatever technical standards are lawfully prescribed by the Federal Communications Commission. (1977 Code § 5.28.100)
4-3-13: VIOLATIONS:
From and after the effective date hereof, it shall be unlawful for any person to construct, install or maintain within the City, any equipment or facilities for distributing any television signals or radio signals through a cable television system, unless a license authorizing such use of such street or property or area has first been obtained, and unless such license is in full force and effect. 4-3-14: PENALTY:
Any person violating or failing to comply with any of the provisions of this Chapter shall be guilty of a misdemeanor and for each day of violation or failure to comply the person so violating may be subject to penalty as provided in Section 1-4-1 of this Code. (1977 Code § 5.28.140; amd. 2000 Code)
