A. Removal Of Natural Soil; Permit Required: It shall be unlawful, within the corporate limits of the City, for any person to make any excavation in any of the public streets and alleys, and to disturb and remove from the surface of said streets and alleys any of the natural soil, dirt and earth belonging thereon, except as provided in this Section, and without first obtaining a license as provided for in Section 8-1-2 of this Chapter. B. Improving Streets: Nothing in this Section shall be construed to prevent or to prohibit the use, working, grading and improving said streets and alleys as may be authorized by law, and ordinances of the City. (1977 Code § 12.02.020)
C. Penalty: Any person violating any of the provisions of this Section shall, upon conviction for each and every offense, be subject to penalty as provided in Section 1-4-1 of this Code. (1977 Code § 12.02.030; amd. 2000 Code)
A. Application For Permit: It shall hereafter be unlawful for any person, association, corporation or company to make or cause to be made, any excavation in any of the streets, avenues, alleys or other public grounds within the corporate limits of the City for the purpose of erecting or placing any telephone, telegraph, electric light or other like poles, or pole used or to be used for any like purpose, or to erect any poles therein without first making application to the Street Superintendent for a permit to do the same, and obtaining from said Superintendent a permit in writing to make such excavation and erect such poles.
B. Contents Of Application; Pole Location: Such application shall show the location of such poles when erected, but such location may be changed by the City Council so as to conform to existing conditions and the ordinances of the City; and the location of such poles, when determined, shall be, in all cases, done under the supervision of the Street Superintendent acting under the advice and direction of the City Council.
