(A) No person operating a motor vehicle on a flooded street, highway, alley or parking lot, whether public or private property, shall operate the vehicle so that it causes a wake that could cause damage to other vehicles or adjacent real property, or cause substantial inconvenience to an owner or occupier of adjacent real property.
(B) It is an affirmative defense to a charge under this section that the operator was operating an emergency, public safety or official government vehicle directly in furtherance of official duties.
