§ 151.093 STREET DESIGN AND CONSTRUCTION.
   All streets in a hillside subdivision shall be designed and constructed in accordance with § 151.069.

DEFINITIONS
§ 151.105 SUBDIVISION DEFINED.
   (A)   As used in this chapter, the definition of the word SUBDIVISION is defined in G.S. § 160D-802, as now or hereafter amended.
   (B)   The definition is as follows: A SUBDIVISION means all divisions of a tract or parcel of land into two or more lots, building sites, or other divisions, when any one or more of those divisions is created for the purpose of sale or building development (whether immediate or future) and includes all divisions of land involving the dedication of a new street or a change in existing streets; however, the following is not included within this definition and is not subject to any regulations enacted pursuant to this chapter:
      (1)   The combination or recombination of portions of previously subdivided and recorded lots if the total number of lots is not increased and the resultant lots are equal to or exceed the standards of the village as shown in its subdivision regulations;
      (2)   The division of land into parcels greater than ten acres if no street right-of-way dedication is involved;
      (3)   The public acquisition by purchase of strips of land for widening or opening streets; and
      (4)   The division of a tract in single ownership the entire area of which is not greater than two acres into not more than three lots, if no street right-of-way dedication is involved and if the resultant lots are equal to or exceed the standards of the village as shown by its subdivision regulations.

§ 151.106 TYPES OF SUBDIVISIONS.
   For all subdivisions of land, as defined in § 151.105, the following categories of subdivisions shall be used to determine the procedures required for review.
   (A)   Major subdivision. A subdivision of land by a property owner into more than ten lots or parcels for the purpose of sale or development (whether immediate or future).
   (B)   Minor subdivision. A subdivision of land by a property owner into not more than ten nor less than three lots or parcels for the purpose of sale or development (whether immediate or future).
   (C)   Special subdivision. Other divisions of land for specific uses not otherwise specified by this chapter (which may include such examples as cemeteries, boundary disputes, and the like); subdivision of property into two lots; and the subdivision of land within a residential planned unit development (RPUD), provided subdivisions in these developments conform with the requirements of § 154.129.
   (D)   Cluster subdivisions. The subdivision of land which permits the reduction of the required minimum lot sizes and dimensional requirements, subject to the dedication of required open space. Cluster subdivisions may be permitted in the R-1 and R-2 zoning districts in accordance with requirements and standards in § 154.130. Additionally, the cluster subdivision shall be reviewed in accordance with the procedures and requirements for a major subdivision.

§ 151.107 OTHER DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BUFFER EASEMENT. An easement not less than ten feet in width adjacent to a major street or a commercial or industrial development which may be required by the Village Council. The Village Council may require the grading and planting of said BUFFER EASEMENT.
   COMMUNITY SEWER SYSTEM. Any sewer system owned and operated by Carolina Water Service Company, the village, or other sewer system serving two or more connections.
   DEDICATION. A gift, by the owner, or a right of use of land for a specified purpose or purposes. Because a transfer of property rights is entailed, DEDICATION must be made by written instrument and is completed with an acceptance.
   EASEMENT. A grant by the property owner of a strip of land for a specified purpose and use by the public, a corporation, or persons.
   HILLSIDE SUBDIVISION. A subdivision in which land proposed to be subdivided has at least a 16% slope, as defined in §§ 151.090 to 151.093.
   INDIVIDUAL SEWER SYSTEM. Any septic tank or ground absorption system serving a single source or connection and approved by the County Health Department.
   INDIVIDUAL WATER SYSTEM. Any well or spring used to supply a single connection.
   LOT. A portion of a subdivision or any other parcel of land intended as a unit for transfer of ownership, or for development, or both. The word LOT includes the words PLOT or PARCEL.
   LOT OF RECORD. A lot which is part of a subdivision, a plat of which has been recorded in the office of the County Register of Deeds prior to the adoption of this chapter, or a lot described by metes and bounds, the description of which has been so recorded prior to the adoption of this chapter.
   LOT TYPES.
      (1)   CORNER LOT. A continuous (through) lot which is accessible from both streets upon which it fronts.
      (2)   DOUBLE FRONTAGE LOT. A lot other than a corner lot with only one frontage on a street.
      (3)   SINGLE-TIER LOT. A lot which backs upon a limited access highway, a physical barrier, or another type of land use and to which access from the rear is usually prohibited.
      (4)   THROUGH LOT or DOUBLE FRONTAGE LOT. A lot other than a corner lot with frontage on more than one street. THROUGH LOTS abutting two streets may be referred to as DOUBLE FRONTAGE LOTS.
   PLANNING BOARD. Sugar Mountain Planning Board.
   PLAT. A map or plan of a parcel of land which is to be or has been subdivided.
   PRIVATE STREET. A dedicated private right-of-way which affords access to abutting properties and conforms to the requirements of § 151.069(A)(2) and (B).
   PRIVATE WATER SYSTEM. Any water system serving from two to 14 connections, inclusively.
   PUBLIC STREET. A dedicated public right-of-way for vehicular traffic which affords access to abutting properties and conforms with the requirements of § 151.069(A)(1) and (B).
   PUBLIC WATER SYSTEM. Any private or municipal water system owned and operated by the village, Carolina Water Service Company, and any water system serving 15 or more residential connections or serving more than 25 year-round residents.
   PUBLIC WORKS DIRECTOR. Sugar Mountain Public Works Director.
   STREET LINE. The edge of the roadway pavement.
   SUBDIVIDER. Any person, firm, or corporation who subdivides or develops any land deemed to be a subdivision as herein defined.
   SUBDIVISION ADMINISTRATOR. An official or designated person of the village responsible for assisting in the administration and enforcement of this chapter.
   VILLAGE. The Village of Sugar Mountain, North Carolina.

§ 151.108 WORD INTERPRETATION.
   For the purpose of this chapter, certain words shall be interpreted as follows:
   (A)   Words in the present tense include the future tense;
   (B)   Words used in the singular number include the plural, and words used in the plural number include the singular, unless the natural construction of the wording indicates otherwise;
   (C)   The word PERSON includes a firm, association, corporation, trust, and company as well as an individual;
   (D)   The words USED FOR shall include the meaning DESIGNED FOR;
   (E)   The word STRUCTURE shall include the word BUILDING;
   (F)   The word LOT shall include the words PLOT, PARCEL, or TRACT; and
   (G)   The word SHALL is always mandatory and not merely directory.

CHECKLISTS
§ 151.120 PRELIMINARY PLAT CHECKLIST.
   The preliminary plat shall be clearly and legibly drawn at a scale of not less than one inch to 200 feet. The preliminary plat shall be prepared by a registered surveyor and shall include the following information prior to consideration by the Planning Board.

Checklist:
(a) Title Block:
                      Subdivision name, subdivider’s name, North Arrow, scale (denoted graphically and numerically), date of plat preparation, location of subdivision (township, county and state), name and seal of registered surveyor preparing plat, deed book reference.
(b) Vicinity Map:
                       A sketch vicinity map showing the location of the subdivision in relation to the surrounding area.
(c)   Tract Boundaries:
                            The boundaries of the tract or portion thereof to be subdivided, with all bearings and distances shown.
(d)   Property Lines:
                         Property lines and owners’ names of abutting properties and/or abutting subdivisions of record.
(e) Natural Features:
                         Significant natural features including wooded areas, marshes, major rock outcrops, lakes or streams, or other natural features affecting the site.
(f)   Existing Features:
                         Existing features including buildings, streets, power lines, drainageways, sewer and water lines, utility easements, and village limit lines both on or adjacent to the land to be subdivided.
(g)   Topographical Lines:
                         Topographical contour lines not to exceed five (5’) foot intervals when the area to be subdivided exceeds two (2) acres or has proposed streets which will exceed eight hundred (800) lineal feet. Any land proposed for a hillside subdivision shall be required to submit a topographical mapping at intervals not exceeding five (5’) feet.
(h)   Lot and Street Lines:
                        All proposed lot and street right-of-way lines with approximate dimensions, lot and block numbers; all easements; designation of any dedication or reservations to be made; a notation of building setback lines; and proposed use of land. Designation of public or private streets.
(i) Street Layout:
                        Typical cross section of proposed streets, vertical grades, and proposed street names. The street design shall incorporate the minimum design standards required by the Department of Transportation. All proposed streets shall be approved by the Public Works Directors and said approval shall accompany the preliminary plat.
(j)   Water and Sewer Layout:
                        Proposed water and sewer system (excluding individual water and sewer systems), including line sizes, approximate location of manholes, pumps, hydrants, force mains, or treatment facilities; and the connection of the proposed system(s) with existing systems. Where approval of water supply or sewage disposal is required by this Ordinance, written verification from the appropriate state or local officials shall accompany the preliminary plat.
(k)   Drainage System:
                        Proposed drainage facilities, including approximate location and dimensions of open drainageways, storm sewers, culverts, retaining ponds, or areas where water is to be diverted through grading. All drainage facilities located within or outside of the street facilities located within or outside of the street right-of-way which would carry runoff from streets shall be designed to the Department of Transportation’s minimum construction standards. Documentation of approval of the street drainage system from the Public Works Director shall accompany the preliminary plat.
(l)   Other Improvements:
                        Proposed location and description of any other improvements including, but not limited to, riding trails, sidewalks, pedestrian or bike ways, reserved open space or recreational facilities, commercial areas, or buffer strips.
(m)   Site Data:
                        Total acreage in tract to be subdivided, smallest lot size (square feet), total number of lots, lineal feet in streets.
(n)   Tree Protection Plan and Tree Inventory:
                        The decision of which trees to preserve as shown on the tree inventory shall be made jointly during the project approval process.

§ 151.121 FINAL PLAT CHECKLIST.

ADMINISTRATIVE REQUIREMENTS
                      Notice that improvements guarantee has been accepted or certification of improvements
has been granted.
                      Submitted within twelve (12) months of preliminary plat approval, unless written extension is granted by the Village Council.
                      Final plat is eighteen (18”) inches by twenty-four (24”) inches and is at a scale of at least one (1”) inch equals (=) two hundred (200’) feet.
                      Seven (7) copies submitted, one (1) reproducible and six (6) prints.
REQUIRED DATA
(a) Title Block:
                      Subdivision name, North Arrow, scale (denoted graphically and numerically), date of plat preparation, location of subdivision (township, county and state), the name(s) of the owner(s) and the registered surveyor responsible for the subdivision (including the seal).
(b) Tract Boundaries:
                      Exact boundary lines of the tract to be subdivided, fully dimensioned by lengths and bearings, and the location of intersecting boundary lines of adjoining lands.
(c) Adjoining Property Owners:
                      Names and deed references (when possible) of owners of abutting properties and subdivisions of record (proposed or under review).
(d) Location of Improvements:
                      All visible and apparent rights-of-way, watercourses, utilities, roadways, and other such improvements shall be accurately located where crossing or forming any boundary of the property shown.
(e) Engineering Data:
                      Sufficient engineering data to determine readily and reproduce on the ground every straight or curved boundary line, street line, lot line, right-of-way line, and easement line, including dimensions, bearings or deflection angles, radii, central angles, and tangent curved property lines that are not the boundary or curved streets. Building setback lines are to be notated.
(f) Monuments:
                      The accurate locations and descriptions of all monument markers and control points.
(g) Lot and Block Numbers:
                      The blocks numbered consecutively throughout the entire subdivision and the lots numbered consecutively throughout each block.
(h) Streets:
                      Street names and right-of-way lines of all streets. The designation of all streets as public (or private when approved by the Village Council in accordance with the provisions of this Ordinance).
(i) Rights-of-Way:
                      The location and dimensions of all rights-of-way, utility or other easements, riding trails, natural buffers, pedestrian or bicycle paths, and areas to be dedicated to public use with the purpose of each stated.
REQUIRED CERTIFICATES
   The following certificates are to appear on the final plat in such a manner as to ensure that the said certificate will be legible on any prints made therefrom, or are to be submitted with and recorded with the final plat in accordance with the provisions of this Ordinance:

IMPROVEMENTS GUARANTEE AGREEMENT

THIS AGREEMENT WAS MADE AND ENTERED INTO this the          day of                           , 20         , by and between (Subdivider) hereinafter known as “the Subdivider,” and the Village Council of Sugar Mountain, hereinafter known as “the Council.”
WITNESSETH:
   WHEREAS, the Subdivider is attempting to secure from the Council approval of a final plat of a proposed subdivision to be known as the                                           Subdivision to be located within the jurisdiction of the Village of Sugar Mountain, North Carolina; and
   WHEREAS, a village ordinance entitled Subdivision Ordinance of the Village of Sugar Mountain, North Carolina, as adopted by the Village Council on the           day of                      , 20      , (and as subsequently amended), requires the completion of certain improvements prior to final plat approval by the Council; and

   WHEREAS, the Village Council of Sugar Mountain and the Principal have this date entered into
an Agreement by which said Council will approve the Principal’s final plat for the                                         Subdivision prior to the completion of required improvements, and the Principal has agreed to file a Surety Bond in the amount of $         securing to the Village of Sugar Mountain through said Council, the actual completion of said required improvements on or before the       day of                , 20       , which Agreement is attached hereto as Exhibit A and made a part thereof; and
