§ 93.99 PENALTY.
   (A)   Any person, firm, or corporation who violates the provisions, requirements, or specifications of the standards of safety, shall be fined not less than $10 nor more than $500, or confined in jail for not more than 60 days, or both. Each day the violation continues shall, in the discretion of the courts, be considered as a separate offense.

   (B)   Any person who permits a building or structure owned by him to be burned, in whole or in part, without a permit as provided to §§ 93.10 through 93.13, inclusive, and any person who participates in the burning, in whole or in part, without a permit having been issued, shall be guilty of a misdemeanor, and upon conviction shall be fined not less than $25 nor more than $200.

   (C)   A violation of §§ 93.20 through 93.22, inclusive, shall be punishable by a fine of not less than $10 or more than $100. Each day that the siren remains located in violation of this chapter shall constitute a separate offense.

   (D)   (1)   Violations of §§ 93.35 through 93.40 may be prosecuted in proceedings by the city, or by the Jefferson District Court.
      (2)   Any person, firm, corporation, or other entity found to be in violation of §§ 93.35 through 93.40 by the City Council may be assessed a civil penalty payable to the city in an amount not less than $50 nor more than $500.
      (3)   Any person, firm, corporation, or other entity found to be in violation of §§ 93.35 through 93.40 by the Jefferson District Court shall receive a fine not to exceed $500.
      (4)   Enforcement authorities or police officers shall immediately confiscate any fireworks believed to be in violation of §§ 93.35 through 93.40. Following an appropriate hearing, if no violation is found to have occurred, said confiscated fireworks shall be returned by the enforcement authorities or police officers to the person, firm, corporation, or other entity from who they were obtained. Following an appropriate hearing, if a violation is found to have occurred, the confiscated fireworks shall be destroyed by the appropriate enforcement authority.
