"Dwelling unit" means a group of rooms arranged, maintained or designed to be occupied by a single- family and consists of a complete bathroom with toilet, lavatory and tub or shower facilities; kitchen facilities with approved cooking, refrigeration and sink facilities; and approved living and sleeping facilities; all of which are used exclusively by such family.
The words "dwelling unit", "apartment" and "suite" shall be considered synonymous.

"Rental unit" means any dwelling unit; or any rented room within a single family or two-family dwelling or duplex; or the third floor of a two-family dwelling or duplex, where either money or other valuable consideration is paid for occupancy of such unit, or a person, not the record owner, is occupying the unit, whether or not such person pays money or other valuable consideration therefor. "Rental unit" does not include a room for rent in a hotel as defined by Section 1403.13.

"Family" means an individual or two or more persons related by blood, marriage, guardianship or legal adoption, living together as a single housekeeping unit within a dwelling unit. A family may also consist of not more than three unrelated persons. Members of a licensed charitable organization, persons conforming to Section 710.02(g) of these Codified Ordinances and members of a protected class of handicapped persons under the applicable Federal Fair Housing Amendments Act of 1988 (42 USC 3601 et seq.) are excepted. When three unrelated persons live together in a single housekeeping unit, one shall be designated as the head of household.

"Head of household" means:
(a) In an owner-occupied dwelling unit, apartment or condominium unit with a single owner, the head of household is the single owner.
(b) In an owner-occupied dwelling unit, apartment or condominium unit with more than a single owner, the head of household is the adult owner who has the greatest number of related occupant family members (as defined in Section 1403.10) or such other adult owner as the co-owners may designate.
(c) In a non-owner occupied dwelling unit, apartment or condominium unit with a lessee or tenant, one person shall be designated as the head of household.

"Habitable room" means a room or enclosed floor space used or intended to be used for living, sleeping or eating purposes, excluding bathrooms, toilet rooms, laundries, pantries, dressing rooms, storage spaces, foyers, hallways, utility rooms, heater rooms, boiler rooms, basement recreation rooms and areas used for kitchen purposes. Wherever living, sleeping or eating space is included in a room or area also used for kitchen purposes, the Building Commissioner shall determine the portion of the floor area used for kitchen purposes and such portion, so determined, shall not constitute habitable floor area in determining the habitable floor area of a dwelling unit.

"Hotel" means a building originally designed for hotel purposes and meeting all requirements of state and City laws, rules and regulations in which all or a part thereof is occupied, used, maintained, advertised or held out to the public to be a place where sleeping accommodations are offered for pay to transient guests and in which five or more rooms are used for the accommodation of such guests. For the purpose of this Code, "hotel" includes motels and motor courts meeting these requirements.
