§ 150.01 INTENT.
   This code shall establish the minimum regulations governing the conditions and maintenance of all property, buildings and structures by providing the standards for supplied utilities and facilities and other physical things and conditions essential to insure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of the structures; known as the "Property Maintenance Code".
§ 150.02 ADOPTION.
   The 2018 International Property Maintenance Code be and is hereby adopted as the Property Maintenance Code of the village; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of the 2018 International Property Maintenance Code are hereby referred to, adopted and made a part hereof, as if fully set out in this Code, with the insertions, prescribed in § 150.03.

§ 150.03 INSERTIONS.
   The following sections are hereby revised as follows:
   (A)   Section 101.1:

§ 150.04 APPLICATIONS FOR PERMIT OF OCCUPANCY AND CERTIFICATE OF OCCUPANCY.
   (A)   (1)   The application for a “permit of occupancy” shall be completed by the owner or manager of the property. Inspection fees must be paid at the time of the inspection. The property owner/agent is responsible for making payment and scheduling the required inspection.
      (2)   An inspection shall be valid for one year from the date of the occupancy permit. Even if the occupancy changes, the dwelling unit does not have to be re-inspected during that period.
   (B)   (1)   Re-inspection, “permit of occupancy,” is required if the property does not pass the original inspection. The owner/agent has 30 days to schedule the re-inspection. It will be considered a new inspection if it is not scheduled in 30 days. If the re-inspection fails another time, the owner/agent has 14 days to schedule the re-inspection until the work is completed.
      (2)   Failed inspection results will be emailed or mailed to the owner/agent.
   (C)   (1)   The application for a “certificate of occupancy” shall be completed by the tenant/occupant. New owners/tenants can apply for their certificate 24 hours after the permit of occupancy has been issued. The certificate must be secured before the unit can legally be occupied. Area schools also require this certificate for the enrollment of students.
      (2)   The following information will be required before issuance of the certificate of occupancy:
         (a)   A current copy of the permit of occupancy. See § 105.04 (A).
         (b)   A list of the names and ages of all tenants/occupants.
         (c)   A photo ID of the person filling out the certificate.
Note: To change a certificate of occupancy, the village requires a photo ID and approval from the owner/landlord/property manager.
   (D)   The applications shall be furnished by village staff.
   (E)   The fee shall be as established by Chapter 34 of the Village Code and paid before any permit is issued. (occupancy inspection $50.00; reinspection $35.00 per re-inspection; certificate of occupancy $10.00)

§ 150.05 REJECTION OF APPLICATION.
   If the applications do not comply with the requirements of all pertinent laws, village staff shall reject the applications in writing, stating the reasons therefor. Furthermore, village staff shall reject any application or deny occupancy in such case when an applicant, person applying for a permit of occupancy or certificate of occupancy or the owner of the property failed to pay in full village liens, village issued utility bills, or any other fees which are due to the village.

§ 150.06 RESERVED.
§ 150.07 DUTY OF PUBLIC UTILITIES.
   (A)   Every person or persons, firm or corporation or other business entity, whether public or private, that sells or supplies utility services within the village limits of the village, including, but not limited to, water, electricity or gas, but excepting telephone service, shall neither commence the service nor initiate providing the service to any dwelling, or to any portion thereof, to any person or party unless the person or party intending to occupy same, has presented to the utility supplier or provider an occupancy permit or temporary permit to owner/agent wherein the signature of the appropriate village official is affixed thereto and his or her seal is imprinted thereon.
   (B)   This section shall not apply to any occupancy wherein the occupant is seeking restoration of utility service subsequent to a discontinuance or disconnection of same or where the occupant is seeking additional services at the same dwelling.
